CRB and a job that don`t invole driving !!

Hi all,
Well i got my position nursing in the NHS 3 months ago, my CRB came back Friday with a driving ban of 1 year in 2006, when filling in the application form i did not declare it as i honestly thought that once ban was over in 2007 and fine was paid that it was all over, UNFORTUNATELY no i was sacked today from a job i loved dearly but it does not include driving for my position, i have spoken to HR who were surprised that they did not attend my meeting, which may i add i was called into while on the sick !!!!......Seems the justice system and NHS are in ruins, i have never harmed or hurt anyone and all i want to be able to do is help people but a driving ban almost 4 yrs ago has not stopped a career i loved with a passion.....

Sorry to hear about this. If I were you I would contact my union representative as it seems the process has not been dealt with properly. The NHS have specific policies and procedures in place for such matters and they must follow these guidelines especially when sacking someone.
I would also question the matter about being called into work to be told you were sacked whilst you were off sick.
I hope you are in a trade union as some unions give you some free legal advice on such matters and this may be worth you looking into.0 -

Unfortunately i wasn't a member of a union, i have called HR who were rather surprised that they were not there !!! can`t believe it i loved my job....thank you0 -
The issue is not that you had a driving ban, but that you did not declare your criminal record.
The NHS is not in ruins, just protecting it's patients from those who are dishonest.Gone ... or have I?0 -
Yes its everyone elses fault that a question which is very clear in what is required you answered incorrectly.
You had a criminal record and lied about it. Dismissal thus is justified and the terms etc will have clearly said this.0 -
what was the ban for...the reason for the ban may have some bearing on this?
Are you a registered Nurse or health care assistant? if you are a registered Nurse did you report the conviction to the NMC?0 -
Also meant to say that if you lie on a job application and the NHS employer finds out about this will often be gross misconduct and thus sackable, in the nhs or other area where you are in a position of trust most "spent" convictions arnt spent and you have to declare them...this is for the safety of patients!
The solution to this is to always be upfront about any conviction as you can always explain it at interview if required0 -

Nursing Auxiliary and have done this job for 10 years, it was a ban for no insurance which i had overlooked as my ex husband had canceled it on separation and and i failed to appear as the court letter was sent to our old address, so they came down hard on me, it wasn`t anything awful......when you think that there has been horror stories about things which have happened in the NHS as in stealing ect, never stole anything in my life nor would hurt anyone, i honestly thought it was over an done with when the ban was finished0 -
to be fair its not a minor problem.....you drove without insurance and then failed to attend court to answer the charge (presumably you knew the summons was coming from when you were caught)...this suggests a dishonesty from the start....further worsened/reinforced when you failed to declare this on your application form.... I can see your point of view but look at it from a ward managers point of view..what would you do in their situation?0

Driving without insurance and then not appearing in court when due is awful.
Then lying about it to get a position of trust is also lying.
And you honestly thought? did you not bother reading the forms etc were it clearly stated to disclose all action or face dismissal for lying.0 -

In all honesty if it was their one and only conviction and seeing as they had been in the job 3 months and had nothing but exceptional reports from co workers and patients then i would look at the conviction an assess if they were a threat to people, if not then a probationary period, or look back at the number of years they were with the company and see if there had been any question on their personal ability or reports of dishonesty, it really was not deliberate at all0
