yep your being daft worrying about something that will NEVER happen prosecution will not be an option I guarantee you that..i've seen people with far far far worse backgrounds than you owing a damn sight more that 40K and al they came away with was a BRU/BRO and thats worse case...with the caseloads of most OR offices it's pretty terrible to have to wait so long but they will deal with it as a priority so may be back with a decision sooner rather than laterWe all die. Prosecution is a VERY scary word to be used here......its extremely rare when the insolvency service will contact otger agencies when they suspect fraud..something they would have done almost straight away in amigas case..NOT left it till now. in three years of being here i've only ever seen a court end in a court appreance & thats a whole different thingWe all die. hi amiga, i have seen loads of cases over the years, you wont get prosecuted, if i was to guess maybe 7-8 year BRO something like that, take my word for it, prosecution is only for real fraud or theftHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.

I've been reading your posts for a while and just wanted to let you know what happened to a friend of mine who went BR last year.
He is run up £65,000 worth of credit card, loans and overdraft debt in just over 3 years nearly ALL of it was on gambling. He listed in all down on his SOA and was completely honest about what he had done. When the OR asked him what percentage of his debt was gambling he said approx. 70%.
He explained that going BR was part of him dealing with his problem and that he was receiving help from his GP and seeking help from Gamcare etc. He is unemployed, married and has three disabled children and has spent the last year trying to deal with his addiction and getting his life back on track.
He received an early discharge after just 9 months and did not have any restrictions/extension placed on his BR.
I believe he was shown leniency for his honesty and that he showed a genuine regret for what he had done.
I am sure your case will be resolved soon and you will be fine.

I know I am proberly worrying over nothing, and you guys have much more knowledge of the process than I do so I am more than likely being daft.
But I do find the whole not knowing the worst part of BR. I realise they don't do this on purpose, it takes time to investigate and write reports etc etc. However this doesn't help people like me that are born to worry!
I am still worried sick, despite being told it will be ok by folk who actually know a lot more than me! But thank you all for the kind words, it does really help knowing I have support here.0 -

I can't really offer you much advice as I don't know much about BR etc, however I think Philnicandamy's advice sounded really good. Just wanted to say keep your chin up and keep posting we will all always try to help in any way we can.

I would appreciate someone else confirming my understanding, but my understanding is that the Enterprise Act 2002 repealed section 361 and 362 of the Insolvency Act 1986 which were the offences of failure to keep proper accounting records and gambling and rash and hazardous speculation. Instead, such conduct would be dealt with under the BRO rules. - This means that gambling as such is not a bankruptcy offence which you can be charged and imprisoned for.BSC 2710
