  • My partner has just spoken to consumer direct, and they advise him to write to the company, asking what information their client has, and what they want.

The letter itself says 'We would ask you, therefore, to contact the telogram contact centre by 13th sep 08 on 01252 576376 to establish whether information our client holds is relevant to yourself and we will then be able to bring this matter to a conclusion'.

I was always of the mindset to ignore it but the advisor from consumer direct thinks that things would escalate and that they advise to correspond in writing.

    Dear Sir/Madam

    Ref: xxxxxxxxxxx

You have contacted us regarding the account with the above reference number, which you claim is owed by ourselves.

We would point out that we have no knowledge of any such debt being owed to The Loan Company.

We are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

We would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

We would ask that no further contact be made concerning the above accounts unless you can provide evidence as to our liability for the debt in question.

We await your written confirmation that this matter is now closed. Otherwise we will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

We look forward to your reply.

    Yours faithfully

If you've have not made a mistake, you've made nothing
  • Im confused though - if we correspond then obv we're confirming that are indeed at this address, and as yet the letters we've recieved dont mention a debt.

Should we ignore for now, but if we get letters mentioning debt to then use that template?

    Thanks for your help
  • i ignred the two telogram letters and the letter from solicitor. eventually got a letter from capquest. sent them a prove it letter similar to the one above and demanded proof of the debt they claimed was mine. i got a letter back saying they suspected someone had fraudently used my details and they were passing it back to someone and have heard nothing since.

ignore the telogram ones and wait for the capquest ones, yes it will escalate from telogram pretending to want a cofirmed address to capquest debt demand letters, but better to send the prove it letter to capquest imo.
  • Thankyou for your reply, I think I will do the same.

When I had one addressed to me it was only the first telogram one and after ignoring that I didnt hear anything else which is why I think recieving this one (but to my partner) shocked me a bit. I thought it wouldve stopped after ignoring the telogram one, but obv this doesnt always happen!

Thanks for your advice, I think I'll bookmark this thread!
  • Just received a Telogram, envelope was not sealed, also there was no addressee, just a 'with compliments' type slip with our address on and please call 01252576366 with a reference number. Going to ignore it as it is not addressed to anyone, but I will keep for reference
  • My wife just received a telephone call from someone allegedly calling themselves Eunice from Telogram saying they had a delivery for...... and did he live next door. The number she left was 0870 084 2555 which is very similar to Capquest Debt Recovery who are listed on their own website as 0870 084 2400.

This is a scam, and may well be illegal, or at least against the code of practice, so do not respond in any way. If you have a debt that is more than 6 years old do not acknowledge it in any way, just get help and advice from somewhere like CAB. Many firms buy time barred old debts for trifling amounts and then use all sorts of tactics to try to get you to ackknowledge them so that the clock starts ticking again.
  • Hi,

I have been reading these posts with interest. I too have received a letter from Telegram which I ignored as it is addressed to someone I have never heard of at my address. I have then received a letter from H L Legal again addressed to this person. I have rang Telogram today (withholding my number) to advise no such person lives at that address, I did not give out any of my personal details except the first line of the address so I'm abit concerned that they will now find out who I am and pursue me. I have no outstanding debts though but really don't need the hassle. They tried to make out they had a parcel for this woman and said that they had got the information from Equifax for the name and DOB of this person, the DOB was not on the letter and I didn't ask them what it was. They gave me a number for Equifax and said I should get the details of this person removed.........

Any advice on what I should do should they send me anymore letters either for this woman or if they find out my identity from some unscrupulous method?

Send the following letter to them asap by recorded delivery, don't bother waiting for any further mail to come through

  • Thank you for the response to my post. I will get the letter sent and see if I get further correspondence after the 4th March which is the date stipulated for contact on the H L Legal letter. It will be interesting if I do receive anything further, if the name has changed from this person whom I do not know to someone else or even my name.
