    Glowy and Zorb.

I have read this thread from start to finish, except the "missing" pages.

Do you get round to putting your hands up to getting it so wrong?

You argued strongly that you knew consumer law and it was proved convincingly that you don`t.

And maybe now, Glowy, you can go back to your shop and inform your collegues the Law in the real world.

Did you apologise for argueing something you knew nothing about?

Proved by who? That marks dude, Im not wrong and im nt going to hold my hads up to anything, I came here to try to put my side but as usual the 'blinkers' come into play and nobody seems to see any reason, some of the statement that were made on here where ridiculous. Some of the general public really do think they know more than they do....

    General public? LOL

YOU are the general public. Just because Comet tell you you are special does not mean that you are.

You said a purchasers contract was not with Comet but was with the manufacturer.

    Wrong

I love that word contract, I hear it so often. Like I said I explain the returns procedure to every customer, its even on the back of the receipt, so whether you believe your 'contract' to be with us or the manufaturer is irrelevant, if you sign the receipt then you accept 'our' terms and conditions, if you dont like it dont buy it, geez. I know im special thankyou but I was referring to customers in general, some of the people that post on here seem to think they no ever suc a lot, I do not class myself in that class of general public, shouting, accusing or whatever does not get you anywhere, just makes you (I dont mean you btw) look like an !!!!!!.

Can I just point out one thing that not all comet stores treat their customers badly, which store was this? Our store has a very good reputation with our local curries being known for being discount merchants.

I won't be mentioning the particular store as I don't think it's the store at fault, I think it's the attitude that is instilled into the staff through training!

I actually think its the attitude of the individual. The new training system that has just been put into place is very different, Comet are making a concerted effort to try and build a decent rep with customers. Our store regulary gets praise from customers on how polite and helpful we are.

I can't remember the last time I signed a receipt. In fact, I can't remember the last time I was allowed to read the reciept before actually paying for the item.

Oh, and even if someone signs a contract, they cannot be bound by any terms that contradict the law.

That is why you are so very very wrong. You cannot have terms and conditions that override the law. Surely to god you know that.

Same as putting a sign up saying "no returns or refunds". It means nowt.

What does it say on the back of receipt anyway?

How can you read a receipt before you buy something? Im done arguing now anyway, this is getting nowhere and you dont want to listen as you obviously 'know the law' as you keep telling, funny though at the end of the day if comet are breaking the law then why are they still in business. You really dont know as much as you think marks.

So not only are you an expert on consumer law you are now an expert on contract law, which I can now have some real fun with - just out of interest can you name the 3 of the 5 things that are needed for a contract to be legal?

As I mentioned much earlier on in this topic the fact that comet issue a receipt with T&C's on them does not make it legal - in fact I am sure it would be classed as an unfair contract as the buyer is unlikely to have had time read it before making the purchase - you might also want to look very close at the part where it says "Does not affect your statutory rights", the T&C's are an addition, not an alternative to english law I am afraid.
