    At what point did I say that the T&C override the law? Its says that if your product develops a fault within 28 days or is unboxed we will give an exchange or refund, after that it says (like in most manuals/warrantues etc) that if the product should develop a defect within 12 months it will be repaired free of charge by a comet engineer, if they cant repair it we will offer a refund or exchange, these policies are EXACTLY the same at dixons,co-op,curries etc even asda are starting to have to reapir their bigger electrical items now.

    I have shown you time and time again how, they never let anything get as far as court, and rely on bullying the customer, but the few who do stick up for themselves get what we are entitled to - I will say it again, go ask your legal department just how many cases they defend in court? I bet the answer is next to none, the reason being they know they are in the wrong and don't want it proven. Same as people speeding, they do it knowing it is wrong, but are willing to take the risk on the understanding that they may get caught but if they do it is unlikely to harm them too much - it being more of an inconvienence having to pay the fine etc.

    As I mentioned much earlier on in this topic the fact that comet issue a receipt with T&C's on them does not make it legal - in fact I am sure it would be classed as an unfair contract as the buyer is unlikely to have had time read it before making the purchase - you might also want to look very close at the part where it says "Does not affect your statutory rights", the T&C's are an addition, not an alternative to english law I am afraid.

    Again at what point did I say I was an expert? All I am saying is that the terms that are offered when purchased are perfectly reasonable, they dont break any laws, because if they did comet wouldnt be allowed to put them on the receipt. A guarantee states that the product purchased should be free from defects within 12 months, if it does develop a fault an authorised engineer will repair or replace it? Is that against the law?

    I doubt it is that, its a cost issue, why the hell would comet want to go to court over a dvd recorder,washer etc, the reason they agree (if they do that is) with the customer is to get rid of them,we dont want people like that in a shop shouting their mouths off about how they know consumer law etc when most of them dont. Again this is not aimed at you, having somebody stand in my shop and shout at the top of their voice not to shop at comet because we are rip off merchants,and how he knows his rights and would be taking us to court, the reason? His 11 month old vacuum was faulty and we wanted to repair it, thats the majority mate, not a clue what they are talking about.

    But they are not reasonable if you have to make the purchase before you get a copy of them. Not once was I offered a copy of them before I have made a purchase, yet I have had them quoted to me on occasions. Now if I wrote my own T&C's on the back of a cheque that I used to pay for those goods from Comet, saying that Comet agree to refund me in full if the item should fail within 10 years, would you say that is fair?

    So you are saying the terms and conditions I just reeled off arent reasonable? You do realise that n nearly everything you purchase that comes with one of those warranty cards it says exactly the same thing, so is that unfair too?

    Nope, it's just I don't understand what difference arguing in a forum with someone who doesn't even work at the relevent store is going to make.

    I just find it a bit disturbing and psychofantic when people stand up for the companies they work for, that's all.

    So you now agree that the contract, and it is a contract, is between the customer and the retailer ( comet )?

    And there is nothing special about a 12 month guarantee either.

    If you sold me a t.v. with a 12 month warranty and it broke down after 18 months or even 30 months, then I would drag comet into SCC and win.

    Goods have to last a reasonable length of time.

    Mainly because some people have a real stick attitude and think they can get whatever they want by shouting their mouths off.
