    That's probably because many people in this country still don't know their rights. It's just as well I do.

    So do I, it appears I now them more than you do, if your item breaks down after 5 months you are not legally allowed to refuse a repair and demand a replacement,its caled wear and tear as well. Im not into name calling either, just having a discussion and trying to get you to see from my point of view.

    Comet have the same policy as every one else who supplys electrical goods (dixons B&Q Department stores.) and yes what they do is within the remit of the sales of goods act. Otherwise they would have been closed down by now.

    No they don't, most retailers T & C's vary, all of them state "Your Statutory Rights are Not Affected", but this is where the argument is - Comet try to tell you that you can not have those rights, I have been on the receiving end of it, I had to look it all up a couple of years ago. I repeat my question about how many times have Comet let it go to court? The reason they won't let it get that far is they are scared that they will loose and therefore have many more claims against them. As for "Reasonable time" this again is not actually a given figure - it would be for a judge to decide, not the store.

    Yes, it would cause me significant disruption.

    DVD Player - I have just rented several DVDs and would like to be able to watch them

    VCR - See above, replacing "DVDs" with "Videos"

    Fan - It's exceptionally hot and I need to keep cool

    TV - See DVD Player/VCR

    Microwave - I need to be able to cook

    Kettle - I need hot water

    Iron - I need uncreased clothes.

    and these are all life threatening? What did you do before you had a microwave? Use a cooker, a dvd? Take them back, kettle? Use a tap. These are very silly reasons none of them majorly important. *scraping barrel*

    Those arent significant disruption! Those are 'wants' not 'needs' - there is a difference!

    I don't want to cut off my nose to spite my face - Comet are the only local retailer for certain brands that I like. Also, I know that if I do have any problems in future, Trading Standards are merely a phonecall away (I have the number in my mobile, just in case I need them).

    Why shouldn't they? I have paid to use an item, not for you to store it for me - Should I then pay for my shopping at ASDA, and wait for a month before they deliver it to me? If I buy something I want to use it.

    Again its not comet that put the contact the manufacture leaflets into boxes it is the manufacturer.

    The reason very few cases go to court is because of the fees. The cost of defending the action soon out weighs backing down. It is often a cheaper approach one court action is about to start just to replace or repair what ever the problem is. This doesnt mean they are admitting to the fault though but its all to do with relative cost rather than who would win or lose.

    Up to about 28 working days, and the court thing, we would go to court as often as we like, but mr smith who demands a new 200 pound dvd recoreder because its broken after 10 months decides not to take it any further because a) he has no grounds and b) it would cost significantly more money than he would wish to spend and devote time to.
