  • Hi Guys, Have just recieved my cc statement, Wellbehealth £30.85 Ultifreshwell £7.39 Contacted my ccc this morning spoke with Jean went through all the usual press 1 for this etc gave all my details then started to explain "jean says just one moment puts me on hold then phone went down, Phoned again went through it all once more spoke with Stacy, who says here is the direct line number but i will put you through - on hold again 4 mins later Catherine comes on gives details again tells her i sent (by registered next day delivery) my cancellation numbers on the 25th Nov she says we only got it 30th ? i say what is happening as you have not contacted me, she says we are looking in to it and we will try to chargeback, i say would it not be easier for you to close my account as these people have over 80 affiliate companies and they will have passed my details on to them i ask her to look at my history usage on my account as i very rarely use it and she agrees very rarely used, but you have agreed to let them pass your details on, its in the T&C's that you should have read, Catherine I did read them when they appeared, after i had released my details for P&P on my free trial with Dazzle white i then cancelled 15mins after the order, but they had already taken the money out before i had come off the site? even though it says just P&P that has to be wrong and illigal.
Sorry Nothing we can do except do chargebacks every time.
Jeas, they were rude, impatient, do not care, its your fault attitude.
I am going to do the following,
    1) send them a letter showing my disapointment at there lack of understanding and help.
    2) Enclose the court papers (all 67 pages against farend)
    3) Enclose the document from Killpishing site (42pages)
    4) Transfer my balance on to another card and close this one, and never deal with RBS again.
    5) Never Ever buy on line again.
God i am so angry at this moment in time.
It has got to be the most stupid ruling ever, everyone including the banks etc knows this company and its different names (RBS do they said they are watching for all the sites associated with Dazzle and Farend) so why not allow the customer the opportunity to cancel any and all agreements.

I've been so silly and got caught up in this they have taken £150 out of my bank account and I can't get hold of anyone I have e-mailed I only received the trial pack on monday 30th november but they have taken the money already. The bank won't help,

    What can I do
  • After receiving email yesterday I now realise that this a scam. As a seasoned internet user and purchaser they got me in the end!! Have had to cancel my credit card to ensure that this company does not take another £99.95. Very disappointed that the product was advertised on MSN. You would have thought that a company as big as MSN would check the validity of companies they sign up. There is a UK number you can ring 02033719369 however this an automated line that allows you to try and cancel your order only to be told to refer back T&Cs "Goodbye" end of call.

Replied to Email only to get a reply saying.

    Dear Customer,
Thank you for your inquiry, but unfortunately this e-mail box is not monitored.
To speak to a customer service representative please call 1-888-694-9257 between 7am and 4:30pm CST.
In the UK please dial 02033719369
    In Australia please dial 0011-888-694-9257

Yes I should have read T & C s! Thought it was a free trial how wrong I was!!!!

    Extract from T & Cs

    3. Unsuccessfully Processed and Refused Payments
Everbright Smiles will make several attempts to process failed payments.
Payments that remain unprocessed after 30 days may be remitted to a third-party collection agency and as such can reflect negatively on personal consumer credit reports.

In instances where customers attempt to reverse charges with their respective financial institutions, Everbright Smiles, LLC WILL dispute the reversal of said charges and in most cases is successful. Unfortunately, banks, payment processors, and credit card companies such as Visa, and Master Card impose large fees associated with payment reversals. The sum total of these fees is typically £/€/$70. You agree to be liable for reversal fees plus a collection surcharge of £/€/$50.
When a reversal is processed, successful or not, the debt will immediately be sent to a third party collection agency for collection which will include pursuit of a judgment and ultimately a negative filing against your consumer credit report.

The paragraph above says it all about this company. Avoid like the plague.

Protuct may work but do you want this hassle?
  • After being scammed by Dazzle Slime I now feel violated by my cc company Crapital one!
They say they will still keep paying the monies requested until I can cancel with the various made up companies and any old tom !!!!!! and harry that Dazzle Slime gave my details to, even if I cancel or close account which will take 5 whole weeks!!!!!!
Just want to curl up and cry really:cry:
    LBM- finally kicked in 16/12/08 @ [strike]£41,862 [/strike] £0.00/ DFD- 24/12/13 :D

  • Everytime there is a glimmer of hope we hear the sad lack of support and understanding by credit card companies and Banks.

There has to be something that can be done to protect the public. These toothpaste scammers are being given vip treatment. There are so many people worried sick this will go on forever.

If the banks are aware what is going on why isn't anyone trying to find a solution.

For heavens sake these financial wizz kids at the banks keep telling us they are worth the vast bonuses we pay them. Are they able to troubleshoot?

Thought I would add my 2 cents into the ring here.

The banks are tied to Visa and mastercard rules, The fact people are silly enough to sign up to this and not read the terms and conditions neither them nor trading standards can assist with.

I deal with these on a daily basis- the banks have no power to get Visa and Mastercard to shut down a particular merchant. My bank has sent a report to Mastercard to advise them of all the different merchant banks these guys use as they obviously are getting 100/1000's of chargebacks.

Its up to Mastercard to shut them down or put stricter requirements in for merchants processing card payments, ie if they are getting a few hundred chargebacks then for them to investigate.

As it stands the bank basically have 4 options with these payments.

Transaction not recognised. - This being you have not made any of the payments not signed up to any trial. The payment is totallly unknown.
Cancelled recurring payment- The cardholder has cancelled the subscription with the merchant or made attempts to and the merchant have continueed to charge them after this date.
Goods not recieved - Cardholder has not recieved any goods for the debits appeared on the account.
Credit not processed- The merchant have not refunded the customers account where the customer has evidence(email/writing) confirming the merchant will reimburse.

That is it. The fact you send goods back to them is irrelevant there is nothing in the Mastercard/Visa rules to enforce a refund unless you have it in writing from the merchant that A- they will accept the goods being returned. B- they will reimburse the account when these are recieved. I would like to add from a personal note Good luck in getting anything in writing from them to confirm this.

So before people go mad at what the bank is and is not doing for them with these payments. Maybe initially maybe everyone should read what they are agreeing too.......

And at the end of the day if you are having problems with all these payments. Simply write to your bank and tell them you cancelled in the trial period. Supply the date of course and they will chargeback all the payments after this date. I have found this is probably the easiest route in light of not having much options with these transactions. The bank need no evidence such as emails etc of a cancelled payment if you have it great but either way.

    Anyways all the best :)

What about the fact they keep changing the t & c?
I was never given the same info twice.

    Definately agree

I was one of the lucky ones and did. But what about the people who dont actually receive anything. Surely there must be something the banks can do i those situations?
Is that not just theft then as the companiy is taking money without actually supplying anything?
And no where in the t&c does it say thay can do this.

So before people go mad at what the bank is and is not doing for them with these payments. Maybe initially maybe everyone should read what they are agreeing too.......

Think you are being a bit harsh.

A recurring theme through this thread is that regardless of wether you do everything your told RE - cancelling, sending product back etc is that this company will still continue to take money from your card.

I had the cancellation email and did everything I was told but they still took the money from my card 3 days after sighning for receipt of the pen.

So that must have been my fault for reading the t&c's and following them as they still did what they wanted. ;)

Also, if you read the lawsuit (in full here: http://www.dazzlesmile.com/epicadvertisingcomplaint.pdf or summarised here: http://www.scamtimes.com/product-scams/dazzlesmile-files-lawsuit-media-epic-advertising-aka-azoogle/ ) you will see that the terms and conditions were deliberately hidden /made difficult to find, either by using tiny text below the fold on the order page (not visible unless you scrolled down the page) but the page was designed to look as though it was all displayed so that you would not know there was more of the page to scroll down to or by having the terms on a seperate page with the link to this also placed below the fold.

It is also not made clear that this is a 14 day trial which starts on the day you order and ends when the product is received back by dazzlewhite. Yet the product may take up to 14 days just to arrive meaning it is impossible to fulfill the terms which require that the product is returned to dazzlewhite within 14 days of ordering to avod the $89 charge! Not to mention that a free trial offer suggests a sample and yet they are charging you $89 for it if it is not returned in 14 days.
It is almost impossible to order, wait for the product to arrive, trial it and then return it back to dazzlewhite all within 14 days!

Many people have also reported that they have followed all the terms to the letter and still been refused a refund or have been told that everything is cancelled only to be charged again - often under various different names - or charged before the 14 day trial period is up. In other cases no product is ever received.

I really do think you are being very harsh here.Your point of reference is to view this company as you would a valued high street brand. It's a very clever scam. People have been duped even the visa/m/c and banks it seems. In your view then there are alot of silly people!

The company keeps changing it's name and T&c's which would seem to indicate they are dishonest.

The banks could excert more pressure on M/C and VISA to review and change the rules. The banks, Visa and M/C really do seem to be on the side of scammers.

This company is taking money for nothing....Laughing all the way to the bank. In fact laughing at the bank!

I think people need to take a step back when viewing this particular merchant.
Visa Mastercard rules cannot be bent.(well very slightly). These companies can only be treated the exact same as any other merchant. Your not able to disregard the rules cause of the dodgy actions of the merchant. Thats up to mastercard and Visa, I

Just to answer Stelly point. - If you have cancelled all you need to do is give your bank the date you cancelled and within the credit card rules they can chargeback every single payment after this date. Its that easy. You do not have to concern yourself at all after you have provided this.

As for people that have not recieved goods its treated the exact same as any other merchant. You have been billed for a product that you have not got and the bank can still chargeback this payment/payments.

I am sympathetic to people that have signed up for this, thats why I stated before the only sure fire way to get all your cash back at the moment until the powers that be get their !!! in gear is in effect lie.

Yes thats right lie. when you have all these payments on the account write to your bank and tell them you cancelled or attempted to cancel within the 10-14-15 days and they have continued to charge you.

I know 2 wrongs dont make a right but in light of the limited action that can be taken why should people be out of pocket. Visa/ Mastercard require no evidence of actual cancellation, other than a date soooo I will leave it in the hands of the people that are reading this thread to decide if they wanna get all their money back or get stuffed for several payments before the date they "actually" cancelled.

All the best with the fight hopefully these sites get shut down but be warned it will just move onto something else that people will sign up for. It was Wuyi- tea before, then Acai berrys, Now teethwhitening crap. Just be on the lookout.

    Good luck
