Having received a letter from Halifax (on behalf of Sainsburys Bank) on Saturday saying that they will be refunding me the total amount I was requesting, I was very refused when my application for judgement was refused on moneyclaim as it is now showing that they have entered a defence! Most weird... I shall wait until the end of the week and then chase it up.
It would appear that they don't know their a*se from their elbow and I'm really not surprised!

The card was eventually paid off but that's after it was transferred to a debt collection agency etc...

Has anyone had Natwest say that they can't trace their account? My Dad sent the data request letter from the CAG site. He included his account number. They have wrote back saying that they can't trace the account and need more information. The account was closed approx 2.5yrs ago. I have posted on CAG but had no response so far.Nevermind the dog, beware of the kids!0

I first read about this on another website (won't mention the name) where some people think we're WRONG to be claiming charges back!?!?
In my defence my bank (no names, again - we're leaving them shortly for a basic account elsewhere, as yet undecided unless someone can recommend a good 'un) this month charged us £30.00 for going £00.01 (yes, that's 1 penny) over our overdraft because a company had set up an unnecessary DD that they hadn't confirmed with us. When I complained to said bank I was fobbed off with 'that's our standard tarriff and we can send you a Customer Satisfaction Survey if you like'. Told her I didn't like and spoke to her supervisor who waived the charge as 'a goodwill gesture'. Pffffffft.
They recently charged us £390 in one go because we're in serious financial difficulties and they wouldn't allow us to spread charges - this meant we were in trouble for over two months and unable to make payments on things. Everything's now backed up, so, I'm, taking them to the cleaners for all the charges they've taken from us over the years, such as the above and £32 charges for VISA payments of £1.53 and the like.

Did you keep a record of what you put in the Particulars of claim box? I need an idea what to write. PRETTY PLEASE, Im needing to start this ASAP, the time expired a week ago, need to get on with it!!!:beer: Well aint funny how its the little things in life that mean the most? Chell my feeling is that under DPA they have to destroy data after 6 years only. So if theyve destroyed his data, tough to them.
Id be taking it to the information commissioner, or to court under the DPA. If youhave a look in the barclaycard section theres abit by moores2525 which gives a letter template to the abbey which you could juggle around and delete a few bits to your dads needs. Having been on the CAG forum for a few weeks now I'd like to answer some of the common questions raised here -
1) NOTE you have to register (for free) on the CAG forum in order to view certain sections, including the library.
2) Read the FAQs section as this details exactyl how to claim charges back and what to put on the various forms
3) If your bank enters a defence to your court claim you will be sent an allocation questionnaire to fill in. Also you will need to pay an additional fee at this stage (this can be included in the claim)
4) You can claim back -
Unpaid DD fees
Unauthorised overdraft fees (but not the interest charged)
Any similar fees
This applies to banks, credit card companies and any other finance companies. Mortgage redemption penalties are a matter for debate although recently someone on CAG did get theirs refunded.
You can't claim back monthly account charges, e.g. the £10 a month for Natwest's advantage Gold account. This is unfortunately a definite service fee although exactly what you get for your money is beyond me.
5) It will take a few days to read all the FAQs and understand how this all works and I recommend reading the thread for your own bank as well to see any small differences (some enter different defences etc). Once you have done this the process itself is very simple.
6) I've seen a lot of people stall when the bank replies refusing a refund or enters a defence to a claim. Most of them do this and all of them pay up before the case gets to court. It is a damage limitation tactic and it works - if half the people stop their claim because they don't think they will get anythign then the banks have saved a lot of money.
7) You can claim for a closed account - companies have to keep records for a certain amount of years (6 or 7 I think) regardless of when the account was closed.
As an update, apparently at least 3 credit card companies are reducing their charges to £12 in response to the OFT ruling. Presumably this will be reported widely by the media and a lot of people will settle for being charged £12 a time.
This does not affect the legal basis on which we are claiming back charges and in fact even a fee of £12 is unlawful.
This should have no effect on claims past this date and may in fact make them easier.
There is a lot of confusing information in the press, due to the information not being reported correctly. Which? for example say that you can only really claim if the charges were more than your overdraft. This is of course untrue - any charges of this nature are unlawful.
I don't work for the CAG or anything by the way - I've just found it to be the most informative and helpful site in relation to claiming back bank charges.
As a disclaimer I am of course neither a qualified lawyer or financial advisor and so any information given here is purely from my own experiences and opinions.0 -
