I've now managed to save up the £120 I needed to make my small claims court claim against Nationwide. Total to be reclaimed is £1030. Which would be very handy! I'll keep you posted.Total debt May 2005 £83,232 :eek:

Hey all, I've searched thorugh, but can't find any mention of this. Feel free to yell if I'm making a prat of myself and have simply missed it somewhere
Can I reclaim charges such as my 'service' charge on my business bank account? I trade as a sole trader, not limited company and I have to pay for the priviledge of using my own account, for example getting change, writing a cheque, putting money INTO the account. Last quarter it came to nearly £150 and that's with me paying suppliers cash to avoid my bank charges!
Can't see why I'm being charged, as I never get to see my business bank guy and use the same counters and deposit slots as 'normal' bank account users.This year I'm getting organised once and for all, and going to buy a house with my wonderful other half. And that' s final!

No, you cannot reclaim 'service charges' - charges where a bank is providing you with a service, such as the ones you describe, cannot be reclaimed. You are paying for that service.
However, you can reclaim charges that are applied to your account for direct debits bouncing or being over your over draft limit and as far as I am aware this does include business as well as personal accounts.Proud DFW Nerd #62

Well, I received a letter at the tail end of last week offering me £260 in response to my £625 claim with Barclays. I KNOW I must keep pushing them for the full amount, but am just a bit concerned that not one Barclays claim has come to fruition yet. On the CAG website there is a survey re: bank charges returned and so far 27 people that have filled it in had their charges returned. I know what you mean though about the money being tempting but keep on going....
On another note I had a claim against halifax through moneyclaim and i just found outtoday that they did not acknowledge it si I appear to have won by default!!!! Does anyone know what next and do halifax have a history of overturning these defaulted wins like the abbey do?

It IS tempting. Of course, it is, that's why they do it.
Time to stoke up your anger: How dare they? It's your money, YOU're suing THEM, and they try to bribe you with your money? The bloody cheek of them!
And hey, remember when they took that money? Was that when you didn't need it so much, or was it when those £30 a time really screwed up your budget? Mhhh? And now, they dangle a little bit of it to make you cave in? Them of the unlimited billions, they are baiting you with a couple of hundreds?
Look at it another way: this was money you never expected to get back. You haven't budgeted it in, as of now, you still dare not. So what's the harm in holding out further for a few weeks longer?
You could write back saying "thks, I'll have that for now, but will keep pursuing the rest until court if need be", but I know Barclays make these in ful and final settlement, and if you say no, they'll withdraw it altogether.
Having said that, I also feel that if they felt they could defend successfully, they wouldn't even offer you half.
Up to you, of course, as always. I know I wouldn't (and haven't, even when they sent me the actual cheque!).
And finally: People have had their money back from Barclays. The survey at https://www.consumeractiongroup.co.uk shows that, and you have to remember that we estimate only about 1/4 of people actually fill in the survey, so you can draw your own conclusions. Barclays seem to hold out for longer, that's all. But since they act as unlawfully as the others, I can't see them being any more anxious to end up in court than the others.0 -

Go to MCOL, and choose the "start" option. It may well be that due to the time betwen filing and deemed served, there may stil be a couple of days before you can actually enter the default. But it would seem that you have won!
I must say, I'm surprised that Halifax have slipped, they are normally right on top of their AoS and usually settle about 10 days after the AoS... I don't know of any that has been left unacknowledged so far, so don't know how likely they are to go for a set aside...
Might be a good idea to go to the CAG website and trawl your way through the Halifax forum, thread by thread, to see if there are others...0 -

Ive nosed around on CAG & asked a few times, but cant find the responses - can anyone help lil me:beer: Well aint funny how its the little things in life that mean the most?
