I also need to download template for Letter Before Action to send to LTSB today - anyone know where else I can get a copy while the site is down? Or even know when it might be up and running again?0

I wouls imagine it's a bit of down time, should be OK in a few hours.0

Hi.. Not posted on this thread before!
I requested my bank statements for the last 6 years with HSBC (the account is now closed), they called me when they received the letter and told me I'd have to pay £10 for the copies... So I told them where to go and that I would try and hunt out my bank statements which are stored at my parents! Anyway low and behold about 2/3 weeks later they all arrive in the post, free of charge... :rotfl:
I haven't yet been through them properly but I estimate I could be claiming back nearly £500! Has anyone had any luck with HSBC??
I do have a quick question, I have a huge loan outstanding with HSBC (now with a collection agency), can they refuse to pay back my charges because of this?0 -

Right, need some advice guys. Got a letter from Cap 1 today saying they admit no liability blah blah blah, but have agreed to refund all charges, plus court costs plus interest. They even kindly worked out that I was owed extra interest to what I had stated in my claim and have agreed to pay that too. However, I have copied the 'settlement form' that I need to sign and return for them to refund all monies:
Settlement Form
To:
Exec Office
Cap 1
Etc
From:
Carly
Etc
County Court Claim Number – xxxxxxxx
Your Ref: xxxxxxxxxx
I confirm my acceptance of Capital One’s offer to refund the default fees, court fee and interest totalling £215.43
I confirm this offer is accepted on a no admission of liability on the part of Cap 1 and in full and final settlement of court claim number xxxxxxxxx. I will not take any further action against Cap 1 and I also agree to notify the court to confirm settlement has been reached.
Signed………………………………………
Date………………………………………...
Signed on behalf of capital one
Xxxxxxxxxxxxx date 18/5/06
I am bit worried about signing this because of the "I will not take any further action against capital one" bit as I am sure that this will tie my hands in future and I won't be able to pursue them again if I need to.
Now, i have no intention whatsoever of getting any more charges, in fact with this money going in I will be only £200 in debt to them (with a £1,200 limit). But sometimes things happen that are outside of your control and I don't want them taking full advantage of a bad/unfortuneate situation for me.
Can I 'edit' the form, eg maybe cross that bit out or add to say " I will not take any further action against cap 1 regarding this matter"?
Can anyone advise please?
There is ongoing discussion as to whether they can actually say this, since it would be effectively denying you the right to legal process, which is of course a Human Rights violation...
I would change it to agreeing that you will take no further action regarding this present claim, but this acceptance has no bearing upon any later action you may need to take against them should they levy further unlawful charges. That should give them something to think about!0 -

Yes. Lots. 2 of our users have just had nearly 5k each worth of refunds, one a couple of weeks ago, one on Friday just gone. Plenty more before that.I do have a quick question, I have a huge loan outstanding with HSBC (now with a collection agency), can they refuse to pay back my charges because of this?
No. In fact, once you have your main account sorted out, and you're more familiar with the process, you migh want to examine the loan account to see if any of that is made of charges and get those back too!0 -

Hello
I'm really eager to try to reclaim some of mine and OH's bank charges. I reckon ours will be in the £1000's. My only little problem is that my employer blocks access to BAG website on the basis that it is a chat room and I dont have access at home. Someone mentioned a blog by martin. Did this include any forms or instructions? I would be eternally grateful to know the basic steps to follow and see the wording of the templates.
Can anybody help??
or is there other simlar websites?
many thanks0 -
