    Classic prev post...wish people could get photos of people getting them! Can someone clarify for me please...do you claim on interest or just those fees when you go over O/d? Bummer if its the latter as I never dis...just used my credit cards!!

    Basically, say you over your overdraft by a quid. You'll then be charges say 30.00 for going over. The interest part of it to claim for is the interest charged on that £30.00 for that time. Not the interest on the overdraft ( ie mines about £6 a month) (and not the interest on the quid either!) but the pence of the interest charged on the "charge" Its a nightmare to explin, andI found it impossible to work out, which is why I just asked for the charges themselves back.

    Ohh I have not posted on tis thread before

    Here is my story so far :-

    Barclays owe me £3,101.72 (over 4 years - account has been closed for 2 years)

    Initial Letter - 04.05.06
    Reply Recieved - 11.05.06
    They said they will reply by - 04.06.06 (Whatever !!)
    LBA sent - 19.05.06
    Claim due to be issued - 02.06.06

    Will keep you all updated

    Right, need some advice guys. Got a letter from Cap 1 today saying they admit no liability blah blah blah, but have agreed to refund all charges, plus court costs plus interest. They even kindly worked out that I was owed extra interest to what I had stated in my claim and have agreed to pay that too. However, I have copied the 'settlement form' that I need to sign and return for them to refund all monies:

    Cap 1

    County Court Claim Number – xxxxxxxx
    Your Ref: xxxxxxxxxx

    I confirm my acceptance of Capital One’s offer to refund the default fees, court fee and interest totalling £215.43

    I confirm this offer is accepted on a no admission of liability on the part of Cap 1 and in full and final settlement of court claim number xxxxxxxxx. I will not take any further action against Cap 1 and I also agree to notify the court to confirm settlement has been reached.

    I am bit worried about signing this because of the "I will not take any further action against capital one" bit as I am sure that this will tie my hands in future and I won't be able to pursue them again if I need to.

    Now, i have no intention whatsoever of getting any more charges, in fact with this money going in I will be only £200 in debt to them (with a £1,200 limit). But sometimes things happen that are outside of your control and I don't want them taking full advantage of a bad/unfortuneate situation for me.

    Can I 'edit' the form, eg maybe cross that bit out or add to say " I will not take any further action against cap 1 regarding this matter"?

    Can anyone advise please?

    Became Debt Free in Oct 2006 - uni was hard - financially!! Now need to start again.... :rolleyes2

    if that is all they owe you and you don't have any more claims against them is there any harm in signing that?

    I processed my claim online and have had no response from Abbey. Today is the 14th day, do they have to respond by today? What happens if they don't??
  • I have received no correspondence from halifax, so do i now proceed to moneyclaim? Any advice appreciated, thanks!
  • hi there. if you have filed claim against abbey as far as i am aware the claim is not deemed to be served until 5 days after you process claim... they have fourteen days from the day that they claim is processed.

    halloween queen if u have waited the amount of days you said in your letters then start claim. on the bank action groupl website there is even a template for what to put.

    I cant access the consumeractiongroup website - can anyone else? Need the template for the initial bank letter - does anyone have it on email they could send me? Wanted to send it today...... (already know which charges I am reclaiming, so need initial letter.....).xx
