I sat & ploughed through 3 years of Natwest statements last night - £1525 back to Feb 03. Am waiting for the previous 3 years statements to arrive - Natwest charge £5, but my branch charged me twice, causing me to go overdrawn, with a charge pending of £35!! They really know how to make money, don't they!

Sorry I didn't reply earlier, I'd lost the thread, lol! (which makes a change for losing the plot, I suppose!)
The site is actually very user-friendly, and if you're not sure, you can save as far as you've gone, and get back to it later, so no worries.
The hardest and most irritating is the particulars of claim, where you have to use a max of 1080 characters on 24 lines, INCLUDING the specific wording for the 8% APR. But practice makes perfect, and you can find guidance notes for filling it in on Consumer Action Group (there was talk, but I'm not sure if it's been done yet, of writing an actual template that would fit in).
Don't worry, until you have actually paid for it, you can change whatever you want on it, so take your time, save your info, go back to it until you're comfortable with it. I've just completed 2 more today, small ones.
So far, I've had my money back from 3 different institutions: Natwest, Halifax, Ikea, all 3 after issuing claim, they acknowledged, then paid up before entering a defense. I've just filed against Barclays Bank and 1st National Motor Finance. I really really wish I'd known all this years ago...0 -

Ok, for you to lose, you would have to end up in court first, and then lose. Mhh. Let's look at this rationally for one moment:
Possibilities for winning: 1) Bank pays up at 1st letter, 2) bank pays up at 2nd letter, 3) bank pays up at claim issuing stage, 4) before acknowledgement of service, 5) after acknowldegement of service, 6) before lodging a defense, 7) after lodging a defemse, 8) at allocation questionnaire time, 9) after allocation questionnaire, but before hearing, 10) any time between hearign date set and actual hearing, 11) on court steps. Or 12) bank goes in hearing, gets trounced.
Possibilities for losing: 1) bank goes in hearing, you lose. Er, that's it. What do you lose? Your court fees, and you never get money back to which you had kissed goodbye a long, long time ago anyway.

Monthly unauthorised o/d fees, yes. Monthly regular o/d fees, no.
Interest, if the o/d is SOLELY due to charges, yes. IF you use your o/d yourself, then you would have to work out which part is the authorised, which unauthorised, which part is levied from the charges, which isn't. Unless the o/d is solely comprised of penalty charges, I usually advise people not to even try, as th ecalculations are far too complicated.
The calculator is for working out your 8% APR as authorised by the County Court Act, and not to be used until you're ready to file your claim.0 -

Thanks for clearing that up, the amount for unauthorised is probably not worth claiming.. To be honest I think I had most unauthorised stuff more than 6 years ago and am I right in thinking I can only claim for the last 6 years?0 -
Now that's a tricky one... The Statute of Limitations 1980 says 6 yrs, however, there is a growing trend of thought that says there may be ground to claim further on account of the bank's deliberate concealment, which would effectively remove that 6 yrs limitation... But it hasn't been tested yet.
I would advise 6 yrs for now, and see how events develop in the future.0 -
Hi everyone, I have been chatting to SS about back claiming back bankcharges and what they mean, he explained and said we might be able to claim some of ours back but to ask you lot to clarify for me.
What it is is my OH has a standard bank account with yorkshire bank, he has no overdraft facilty on it, but if there is insuficunt finds in the account for a DD he gets put over drawn, the DD gets returned unpaid and they give him a £35 charge. Would he be able to claim any of this back do you think?
