I owe Lloyds approx £9K loan, £9K loan, £1100 O/D and £5500 C/C. If they were to take me to court could they lump them all together or as they all have seperate agreements would they be dealt with seperately.
Thanks in advance.

I'm not entirely sure but would have thought that a court would regard each as separate since they should have separate agreements for them all.
Have you tried asking for the CCA's for the loans and CC's since they would need these for the court to enforce them should it come to that.
Hope this helps a bit, as I said am not entirely sure.DMP Support Thread Member 238DMP started October 20080 -
Hi, i have been lurking and reading for a while. May i please join? I have had a DMP with CCCS since about 2003/4 and all going along as normal. Usual occassional hassle from some but have just come across a problem with first direct that never had in the past. They have accepted my cccs payment but have sent me what looks like loan papers this time (first time ever, with interest at 6%!!!!!!!!!!!!!!!!!) am i right to just ignore and wait for this to default to debt collector as would be better off re interest? i will still make normal monthly payment. I owe them about £1200 now and they are not my biggest creditors.
Thank you in advance for your help.
i have also been a bit slack with budget so will pull my pants up and get on with it. will check balances and update signature and DFD, this thread is inspirational.:T

hiya - i wondered if anyone here could give me some advice please!
I am currently trying to get my DMP set up with the CCCS but have decided to start it from Nov 1st to ensure that my salary goes into my new account at the end of this month and also to give me a small cushion in october as my flat mate is moving out, and also to ensure that I have alerted all creditors (one of which I haven't yet as they are my own bank and I want to make sure my salary has gone to my new account before they know in case they remove my overdraft facility!)
So...here are my questions
1) I made all my creditors token payments in September when I sent them the notification of DMP - I will need to send another token payment in October. Has anyone got advice on a letter I could use for this one?
2) Any advice on what I can say to them when they keep calling me - at the moment I just keep saying that the CCCS will be in touch soon with a payment offer, but I feel I should probably give them a bit more information when they receive a 2nd monthly token payment? What do you think?
3) Once I am on a DMP I know my credit rating will be shot to pieces (to be honest it already is so I don't really mind that!) but...my boyfriend and I are planning on moving in together early next year (which will hopefully save me a bit of money on rent which I can then put towards my DMP) however I'm worried about moving out of my (privately) rented property as any new landlord d will no doubt want to do a credit check, which I would surely fail! Not sure what I can do about this - apart from maybe my boyf renting in his name?
So thats it for now! I would be v grateful for any advice about a 2nd month on token payments and how to handle the creditors when they call me etc...the calls are starting to come thick and fast now!
Thank you fellow DMPers!!

Hi Fraggle,
Answer 1: Enclose another DMP notification letter with the start date. By all acc!!!!s they don't usually pay much attention to anything there sent and often claim they've had no correspondence
Answer 2: Either don't answer the phone or if you do feel brave you don't need any explaination. Stick to your guns and say that your starting your plan with the CCCS on the 1st Nov and that you'll send a token payment in the meantime.
Answer 3: Not sure on this one!
Take care

Can't help on your query perhaps give CCCS a call as we're not supposed to sign any additional credit agreements whilst we're on a plan? So 1st direct are breaking the rules.
Update from me, managing well on our budget, 1 week in and no unnecessary squandering, so feel quite good that this month will be better, especially as I have just found out that I need to go on a business trip to Australia for 2 weeks on the 9th Oct.:eek: & :T at the same time.
Our company policy is a nightmare, you have to pay for everything yourself and then claim it back. Therefore had to go grovelling for a cash advance so I can pay for the hotel etc. Also a bit worried as I have no CC and usually hotels ask you to swipe one when you check in, I do have a Visa Debit card so I’ve informed the bank that I going and planning to use the card. Fingers crossed no hic-cups.

Thnk you for posting that, i knew i had read it somewhere and at the time read briefly through it.
It made me feel a lot easier, knowing our property is jointly owned and the mortgage is also joint.I think this link is the forum thread about it - very interesting.0 -
Can anyone tell me how soon the CCCS statement is updated. Mine doesn't show that any payments have been made yet, although they receved my payment on 2nd. I assumed payments to creditors would show after 24th, a little like a bank statement.
Barclaycard have accepted - charging reduced interest, but at 6% I should be able to see real progress on the debt with my proposed payments.LBM July 2009DMP Start 1 September 2009DMP Support Number 3350 -

yay to Australia! how exciting! I worry about the expenses and no credit card thing too! that's the way it works here as well and so far i haven't had huge expenses but what if i do in future. they've also recently changed it so they only do the expenses once a month. before, you spent it, put the form in and got it straight back, now you may have to wait almost a whole month depending on when you sepnd it. this makes me very nervous when i'm living on such a tight budget with no cards and no extra! i've heard my boss make comments about someone who doesn't have a card saying 'how can he cope without a card?'! eeek!
Yay, payday today! so today is the start of my new strict budget regime! fingers crossed i do ok!
i'm already nervous about decembers one coz i've had an invite to a wedding. in scotland, on the 19th Dec. just not sure how i'm going to manage it but really really really want to go! might have to do a lot of juggling and also a lot of turning xmas parties down! :eek:DMP Mutual Support Thread Member No 261Debt at start of DMP (Jan 2009) = 46,147.86 Now = 36,826.98DFD = [STRIKE]Jan 2014[/STRIKE] May 2013 ([strike]60[/strike] [STRIKE]52[/STRIKE] 41 payments to go)NSD:Nov 12/12:jDec 9/10 Jan 5/10Slowly but surely:coffee:0
