geoffmr1 - I can't thank you enough for your last post, it was so easy to read and understand and you certainly have put my mind at rest a little. I've not read anything about making sure they have a copy of the agreement, but will look into this. I'm sure they will have though, as I signed for the loan in branch. But if this is something I could look into for my other creditors then I certainly will look into this. I think the only other option is for me to write a detailed letter to them explaining all I can in regards to my commitment to repaying my debts and about the increases I will be able to offer in the future. fingers crossed they don't proceed and I'm glad to here things won't actually happen as fast as I thought..........I could picture myself in front of the judge next week..........pheeewww. I have the same problem, my Amex account was passed to RMA Resolve within days of me informing Amex of my pending DMP. RMA Resolve accepted my offer through CCCS and I haven't heard a peep from them, like you I would like to receive a statement so that I can keep an eye on my balance, but the reply to your question makes total sense.
Does a DCA have to supply a statement of your account, or is it up to you to contact them to find out your balance ? RMA Resolve never reply to emails or letters and I refuse to speak to them for obvious reasonsDMP mutual support thread member:3270 -
I've been wondering similar too! (not the legality part, that hadn't crossed my mind). I don't get Egg ones I don't think. but this is coz i signed up for internet ones. but now don't know how and if i can find out my balance and if they are charging me interest or not.

I remember a couple of weeks ago on the forum there was a reply about the charging orders and CCJ's, and i seem to remeber it said that if you have a joint mortgage, then a charging order could not be taken out againt you, i think in one of your earlier posts you stated you had a joint mortgage, perhaps one of the people who is a whizz on the forum may be able to post a link to the relevenat thread.

It doesn't matter whether you have a joint mortgage or not, a creditor can still apply for a charging order over your property. I have a joint mortgage & we tried all these arguments against HFC, none of it worked (I decided to fight them though when I found they had an unenforceable credit agreement & they backed down the day before court). All it would mean is that if you sold the property then the money for the charge would come out of your share not the other persons.:j DMP mutual support thread member - 135:j0 -
