  • Daffy, Fantastic, thank you. I have just called cccs who have said the same thing, that it's most likely a scare tactic! I think I'll give Shoosmiths one last call tomorrow to say that there's no way at all I can offer any more money and that they should carry on with whatever path they are wishing to take. I guess I just got a little scared when the word 'court' came into play as things have been pretty quiet since I started my DMP. I'm also really worried as I tod my partner that this owuldn't affect him one bit and it seems to be quite the opposite as everytime he applies for credit I seem to be checked also, resulting in him being turned down.

    One question, if I were to get a ccj would this be on my credit file from the time I get it, or from the day the loan is paid off in full? I just dread to think that I'll be waiting 11 years to get my dredit file back on track! Although I can't see why they think giving me a ccj on top of the default they have already given me would make a difference to the amount I can pay them???

    Good afternoon one and all.

    I'm going through same problem, just starting next month with dmp with cccs. Have been advised to go for charges by other dfw's on here who have been successful. Am claiming credit card charges of £507 back off capital one, £212 off barclaycard, and still trying to get info off mbna (they're playing hard ball, but so am I, have sent letter today threatening them with information commissioner if the don't send list of charges in next 2 weeks):D
    Have been to court about abbey bank charges but they've got a stay on all cases at the minute so will keep eye out for any changes there, as that's for a whopping £3100.
    Am also going for mis sold ppi of about £465.
    Total is a whopping amount which will make a big dent in £21,500 debt.
    Go for it, it's money they shouldn't have and at the end of the day what's the worst they can do, we haven't got any money to give them so let them waste money on letters and phone calls.

    Hi Cleomolly,

    I haven't read back too far so I don't know the exact circumstances, but please bit a little bit careful with advice that CCCS give out regarding legal matters. I have my DMP with them & when it comes to that side of things I cannot fault them. However, when it comes to legal advice or advice in general about legal matters they have been found wanting, quite badly I might add. I won't bore you with all the details but if I'd listened to CCCS I'd now owe HFC thousands more than I do (the debt would have increased from it's original 10k to 20K & I would also have a charging order on my property). Always seek additional advice from this forum & others or from citizens advice if you have one local.

    If you have your own house then Natwest are quite possible going to head to court for a CCJ so they can get a charging order over your property. If you don't own your own property then the threat is more than likely an idle one as court action will cost them money & actually leave them no better off on a monthly basis than they are now.

    The CCJ would stay with you from the time you get it until the debt is cleared. At least with defaults they are removed from the credit file after 6 years regardless of whether they are paid off or not.

  • geof - thank you for that. I was a little wary about cccs as the lady I spoke to couldn't answer my question about the ccj and how long it would stay on my file ect !!! I do have a mortgage, jointly owned, but do you think they would go down that route for the sake of £4500 which is approx what I owe them? also I'm paying them £47 per month at the moment through cccs and they are saying they want £78 per month in order to gurantee the debt will be repaid in 5 years! It just doesn't seem liable to take me to court over £4500, I don't know what to think anymore. do you think I should just wait and see if they do proceed with court papers or should I be doing something else to try and sort this out and get them to accept the payments? would a letter to Natwest be helpful do you think? I just don't know what to do for the best. Thank you, It never seases to amaze me all the helpful advice and support you get on this forum : )

    Regarding paying off small debts (and I'm talking lower than say £500 here), please be careful, as although yes, pay it off and the other creditors will get more money, they won't be getting a huge amount more, and if a regular thing they 'may' see it as being preferential treatment towards one creditor.

    Having said that, I'm sure it's fine to do, just be aware of the above...

    Hi Everyone

    I hope you are all well and your debt is slowly reducing ;)
    All is quiet on my DMP front at the moment and I have to say I am enjoying every second (while it lasts :D)

    Anyway I have managed to open a savings account with Tesco, so hopefully that £10.00 of points will come in very handy, when I eventually get them ;), I am thinking into the future at the moment about Full and Finals, If I can manage to throw a few quid into my savings account every now and then I may be in a position to make some offers in the near future, for example one of my debts is around £50, would CCCS let me pay this off If I could get the cash together or would they expect the £50 to be split between all of my creditors ( they will probably end up with £2.50 each :D) I would rather get rid of one creditor than pay them all a ridiculous amount.


    Word of warning if on a DMP and you prioritise any of your creditors over others - if they have done you any "FAVOURS!" (yer right I hear you say), but even allowed a small token payment or a reduction or freeze in interest, the creditor(s) who are not given the same treatment may call all this in and whack it on, close the account and ask for everything in one go etc. It is not wise. Also, I would say if you publically come into a lot of money during or after the event they may try to get this all back then too. If you win the lottery keep schtum for 6 years ! HA HA (and share with all of us of course).

    On the whole it is not favourable for one creditor over the other unfortunately and if with payplan or cccs all creditors know exactly what the others get and when.. payplan do have the right idea that each creditor gets the same percentage of what you are paying to avoid this.

    Unfortunately each creditor treats every case differently so there is no consistency in what they do. Infact they probably do that purposely so nobody can ever tell you what will happen, they all love using scare tactics to get people to pay up which is amazing considering the only people who are actually worried by these tactics are the people who do actually want to clear their debts.

    I'd love to say they wouldn't go after a charging order for 4.5k but they are petty enough to try. At £47 per month it would take nearly 8 years to pay that loan off & they would argue that they aren't receiving any interest on that amount over those 8 years so it's unreasonable. As you have already said the monthly amounts will be going up over time anyway & I promise you that a judge would consider that amount through the CCCS more than fair. The first thing to do is make sure they have a true copy of the signed loan agreement, even if you have a copy of it already it's worth sending the £1 fee to make sure they have it.

    Always try to pre-empt any moves they will make (you can't always do that, but in this case they have warned you in 14 days they may take legal action, so if you start preparing now you'll be ready for anything they throw at you). They cannot get a CCJ or charging order if they don't have the proper paperwork. Then there is the other stuff you can look at such as a possible PPI reclaim if you have that with the loan.

    Don't get me wrong it may be that Natwest have everything in order & that it's pointless fighting them, but you need to make sure first. You already suggested sending a letter which is a good idea & can never hurt, it has worked for me previously. Whatever you decide to do just make sure you don't do nothing, let them know you won't be bullied.

    As for court itself, thats a long way off. If Natwest do have everything in order & you have no chance of fighting them you wouldn't even be required to attend court, it would all be done by post. Only if they did go for a charging order would you attend & even then it would only be to make sure the judge includes certain terms, such as no forced order of sale.

    Sorry for the long post, I just like to explain things as best I can so I don't leave people worried. I hope some of this helps.

    I owe Lloyds approx £9K loan, £9K loan, £1100 O/D and £5500 C/C. If they were to take me to court could they lump them all together or as they all have seperate agreements would they be dealt with seperately.

    Hello all,

    Had my second acceptance letter this week from Tesco of all people (I've read no end of bad stuff on here about them), including a default notice with the letter and saying they would stop interest. Two down, six to go! I also received one of those "signature required" letters from HSBC, also asking for my date of birth and examples of two recent transactions from my account, before they can "action" anything! I'm going to ignore this again, as per advice on here (I did this when Tesco and Mint asked for signatures and everything is still carrying without it), and if I get chased will act thick and blame the postal strike.

    Anyway, today received a "loan proposal" from HSBC, wanting to lump together my c'card and overdraft into one, asking for - surprise surprise - the same payment that PP is giving them already. There's pages and pages of it together with a standing order mandate for payments from my old bank account with them, and I have ten days to reply (or they "may phone"). Obviously I'm not going to take it up but what's the best approach? Ignore it? Write back saying thanks but no thanks? Also should I tell PP? I've just realised too looking at Justabank that I'm meant to send them any acceptance letters, so must do that.

    EDIT: I've just posted on a new thread about the HSBC thing with more detail now I've read it again. The terms state £0.00 arrangement fees, total interest, and total charge for credit, I've realised, and the standing order part refers to any fees payable, whihc apparently are zero!

  • Also wondered if anyone else was having problems logging into CCCS website, keeps telling me password wrong then when go to get new password tells me e-mail and account number don't match!

    Spoke to CCCS today and clarified e-mail address and a/c no :mad:
