won paypal case but no refund

I recently ordered an item from a website and found after 30 days i did not receieve the item. I then filed a dispute against the paypal, the seller did not respond and so i won the case. But paypal says that the seller has not insufficient funds to refund me. So will i ever get the money back? I paid using a HSBC maestro debit card. Any help would be appreciated.

  • I got screwed in a similar way by paypal.
    Likely answer is no. Unless the seller ends up getting more credit in their account... but assuming Paypal have locked their account now it's pretty unlikely.

    If you want to incurr the wrath of paypal and get your own account locked you can complain to your bank and get them to reverse the transaction. You'll get your money but paypal will say you've broken the terms and conditions of your paypal account, so will close and lock your account (SO REMOVE ANY FUNDS AND WAIT FOR THEM TO CLEAR FIRST!). Afterwards if they're being really moody they'll pursue you for the debt but emailing/writing to you saying you owe them the money you've reversed the transaction for and if it's enough they may appoint a debt collector. Your bank may be willing to help out but unless it's a lot of money to you might want to chalk it up to experience and not do it again.

    Next time, use a cheque. Then it's the banks problem and is genuine fraud.

    nope, you'll get nowt :-(

    unless the seller accidentally fills his 'i'll use paypal to scam people' account up with cash

    take it up with HSBC, though you'll likley find that nothing will happen as they're not as forceful as credit card companies

    Although you could technically look up said seller thought e-bay and paypal and phone him :) Also send him letter (recorded) advising him that you purchased such and such on this and that date and please send you your goods and respond to your mail. Depending on the amount concerned here then if it was enough money you could go to small claims court and if he doesn't show then you could send the bailifs in I think :)

    I used to work for Barclays and you can claim back a debit card payment if you don't receive the goods within a certain number of days (think it was 30 as well). Try calling HSBC and they will probably have similar protection.

    A similar thing happened to me. I bought a pair of shorts for about £2.64. I never received them so I reported it to Paypal and Ebay(its not the money, its the principle). Paypal ruled in my favour and yet said that they were unable to get the funds back from the seller. Then, six months later, when I'd forgotten all about it, I had an email from Paypal saying they were sending me the £2.64 and lo and behold, there it was in my Paypal account! I was really chuffed because you don't expect justice when it comes to Ebay and Paypal!:)

    Thanks for your replies guys. Looks like i'll need a bit of good luck if paypal is to get my money back. I have phoned up hsbc and they filed a dispute. Said it can take upto 10 weeks to investigate. But i think that as it was paid via paypal, HSBC can't do much.

    Do what I'm going to do............. I had a guy who didn't send me the article I won.....and Paypal were useless "insufficient funds" being the cause.
    Lucky for me...the guy lives in a small town and has a unique surname ( he uses a tesco web account in his own name...!!! ). I've confirmed it's him ( don't ask how, but it was very easy!! )...and he lives on his own.

    He's in for an awful fright this weekend when I'm heading via his home with a few footie friends...returning from a match........maybe I'll pop around for a cup of tea and a chat?!

    i would send him a few emails requesting he pays up. Warn him you wont take the matter lighlty and will take him to court if need be. That has worked for me but if he is stubburn and dosent cough up then its up to you wether you want to take him to court. If it was a fairly large sum i would go all the way but you will need to make sure you know where he lives and can proof your case in small clamis court. You only have to fill in a form you can get online.

    Got a call from hsbc today, very friendly person, said they could not do anything about it. Told me to complain to watchdog.
