Since when has it been an offence to pop round for a cup of tea ViJay????....or are you miffed because I had the temerity to pass comment on your diatribe on the concert tickets thread....LOL! nice to see you bothered to care enough to go searching out my threads and passing comment on them....... when you've finished doing that perhaps you can check under eBay to see if anyone is selling a life...and put a bid in for it...;-)

BTW...I did actually get my cash back from the guy...and you'll be Oh, so pleased to know that no threats were made or implied...as if I would... I merely pointed out he'd misappropriated money from a 13 year old child and the decent thing would be to repay it so his honour would be intact. A very civilised conversation with a mutually satisfactory ending, trust that meets with your approval?

    HI
I recently ordered an item from a website and found after 30 days i did not receieve the item. I then filed a dispute against the paypal, the seller did not respond and so i won the case. But paypal says that the seller has not insufficient funds to refund me. So will i ever get the money back? I paid using a HSBC maestro debit card. Any help would be appreciated.

UPDATE: Just last week i got my money back after paypal sent an adjustment payment. But today i got a another e-mail from paypal stating that the buyer had shown proof of postage and paypal stated that i now need to send it back.

    what should i do???

I think the first thing you should do is to request to see this "alleged" proof of postage.

Is it an official proof of postage with a tracking number ? If not, it's not worth the paper it's written (or printed) on.

If it is one of those every-day, run-of-the-mill "proof of posting" receipts you get from the post office, then it is completely worthless. The guy could have gone in and sent anything to anyone and got one, and told PayPal it was your item.

Also, once you get to see this "alleged" proof, check the date and cost (and it might also have the weight on it, I can't remember right at this moment).

    Does sound dodgy though.

I take it you have emptied your PayPal account in the meantime so that PayPal cannot take the money themselves ?

Let us know how you get on as it is quite rare for PayPal to back down on something like this and it'll be useful ammo for future problems with them.

proof of postage is NOT proof of receiving, even PAYPAL know that. Tell then to get lost.

    Thanks for the response kevin.

My paypal is empty, zero balance but is there anyway of paypal getting the money out?? i use my debit card as source of funds.

Shouldn't paypal not take into account the fact the seller as contacted paypal only have papal gave me my refund?

No, if they try it you're protected by your bank who have to refund you.

Thanks for the quick reply. Are you sure it's protected? is it the fact that i have not instructed paypal to give a refund??

It's probably the case, which is why they are asking you to return the money rather than simply taking it themselves.

If they just took it without your consent then it is fraudulent use of your card, whether it be a debit or a credit card.
