    This is not strictly true. There are two cases where you do have protection.
    1. If you pay by a Visa debit card, and you don’t get your goods, you can request the card issuer to perform a chargeback. This is just the same as if you’d bought with a credit card. See Visa debit card refunds.
    2. If your bank account is overdrawn when you make a purchase, or a purchase makes you over drawn, you’re overed by the Consumer Credit Act 1974. See the section What is a credit-token? in Ombudsman News 46 - Using plastic cards as credit-tokens. Section 75 of the Consumer Credit Act makes the card issuer jointly liable for all purchases between £100 and £30,000.
    I’m only repeating what I, and others, have said on the MSE forum. But, I feel it needs repeating until it becomes more common knowledge. :)

    Well I never, didn't know about point 1, though point 2 is rather unlikely to be of use (given having to be overdrawn and spend over £100) :)

    Just for an update, i reported my case to watchdog and got an e-mail today that if they can forward my details to paypal. I agreed and i reckon if more people complain to watchdog, maybe we may get somewhere with paypal.

    same happened to me with a £40 item, but i got £27.02 from paypal insurance and still waiting from the rest from the seller I didnt really expect anything and cannot really understand why i did after reading all your stories

    I have had two experiences of problems with Paypal, the first was from a guy who took the payment, seemed nice enough, plenty of E-mails letting me know it was on it's way etc. but said it was coming from Singapore so would take "around 30 days". I should have realised that there is a 30 day time limit for making complaints to paypal. Anyway, my credit card company allows 60 days to make complaints so I complained to them and they said the would investigate. Got a very rude E-mail from paypal saying this was not the way to handle it etc etc. Anyway, got full refund off my credit card company.

    The second time I had ordered a DVD off a auction site and again, nothing. E-mailed the seller who sent very rude E-mails so I complained to paypal, they took about 2 weeks to investigate and then told me I had won, but there was "insufficient funds" in the sellers account to cover my loss. Straight onto my credit card company, money back no problems.

    My advice is pay through paypal but with a credit card.

    On the subject of taking someone to court over a paypal dispute, here is an interesting article about someone who did just that an won.

    He points out that you have to take them to the small claims court where THEY live, so if they live miles away it might be slightly harder.

    Also (I think) if they decide to send the goods (or refund the money) before the case gets to court I am not sure if you get your £40 back (the money you pay the courts to start the proceedings).

    I have recently suffered the curse of Paypal, to the tune of £55.
    Slightly different circumstances, in that due to previous sales my Paypal account was in credit. The £55 transaction therefore did not go through my credit card company.

    Hot of the press.
    Whilst typing my addition to this thread, I have been patiently been waiting whilst listening to the annoying muzac on Paypal's phone line.

    After a ten minute heated discussion :mad: on the phone to several Paypal representatives...................result :T
    My argument was that the fraudulent seller, might not ever credit his account enabling me to get my money back, so what was the point of being a Paypal customer ? The dispute might take years to be resolved, depedning on whether the seller decides to credit his account. For all I know he might have set it up, made a few bogus transactions and done a runner with a load of cash over a two week period and then shut his account!
    Having informed them that I saw no safety in using Paypal for my transactions, I would be seeking alternative online services.
    Several Paypal personnel later the £55 has been miraculously found from the sellers account details ?????????????????????
    Lessons learned:
    1. Do not rely on email correspondance. It takes too long and eventually dies a death
    2. Threaten to go elsewhere.
    3. Argue...............politely !
    4. Do not accept feeble excuses for poor company policy
    5. Do not have your Paypal account in credit. Make sure any transactions go through your credit card account by deselecting the option to bill your bank account if your paypal account is not in credit.
    6. Dig your heels in.

    I got ripped off by some one who failed to send the item. But i was prewarned and acted before the seller could remove the funds. Paypal found in my favour but due to the sellers feedback being below 98% i was not entitled to a paypal protection claim. instead i was moved to the ebay complaint policy, which stated it will deduct £15 for any money returned.
    As i won i had all money returned bar the £15, i emailed them to request my £15 and threatened them with a chargeback to get it otherwise. they told be to go away as it was there policy. Tescos got me my £15 back which i was really pleased with.

    use paypal but use a credit card that way you can get all your money back.
