Ebay: Ordered a laptop, recieved an Argos catalogue!!

I need some advice for my Brother-in-law...

Last week he tried to win a laptop on Ebay, it ended without him being the high bidder, but the seller emailed him and offered to sell him one privately at the same price, an offer that he accepted and sent a cheque (:rolleyes:).

This morning he received a package, it was a laptop sized box containing nothing more than an Argos catalogue and the return address proves that it is the seller trying it on...so...

Where can he go from here? Obviously PayPal/Ebay are out as it was all done privately, but is there a claim with the small claims court? My concern is that the seller has a receipt from DHL that proves he posted something, and there is little that my Brother can do to prove what was in the box.

    The only hope here is small claims. There is an outside possibility that the seller has conned other bidders as well and maybe a small claims summons may already be in place for one of them, but I don't know if it is possible to find that out?

    I'd go to the police. Then consider the small claims court and maybe trading standards

    Has the cheque been cashed, can he still cancel the cheque.

    I'm totally shocked. Get you bro to call the bank today and see if he can cancel the cheque.

    What is the seller's ebay ID?
    Using that, you may be able to get his details and either take him to court or post poo through his letter box!

    Either way, something needs to be done, that is awful. :mad:

    The seller could easily have done this with an on-ebay purchase.
    Persuaded OP to pay with a cheque.
    Falsified their details.

    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    This is your word against their word. So this is going to take a lot of detective work to find others. Better hope he has done it before or it might need to be the men in the black suits.

    The small claims court is your best bet but be sure to report it to the police as soon as possible and get a crime number.
