    Why do they continually get away with taking upfront fees when they are clearly breaking the rules of holding a licence with the MOJ?

    Why are the MOJ powerless in dealing with the flouting of these rules?

    There seems to be a lack of clarity concerning both up-front fees and cold calling. I have read the rules and have reached the following conclusions:

    1. Up-front fees are allowed provided the business sends to the consumer by post or by email the information set out in Client Specific Rule 11 BEFORE the payment details are taken. In this context "before" does not mean sending the email whilst the customer is on the phone and then taking payment the moment the email pings in to their inbox - the consumer must be given a reasonable opportunity to read what has been sent.

    2. Cold-calling by telephone IS allowed subject to two important caveats:
    (a) it must be done in line with the Direct Marketing Association's Code of Practice, and
    (b) any claim generated from a cold call can NEVER be passed to a solicitor, regardless of how many claims management companies it passes through first. This is because the Solicitors Regulation Authority's Code of Conduct prohibits the solicitor from accepting it.

    I have recently been talking to a company call Kerobo Claims Ltd who have told me that after looking at my details they believe that they can have all my credit card's cancelled as they have been missold.

    They use this website to advertise, Has anyone heard of this company, has anyone completed this sucessfully, are they a genuine claims company or just a scam outfit? They give their address as Ravenstone House, Britannia Road, Sale.

    They are asking for £350 to action - can't afford to lose anymore so please advise? Confused in need of help?

    Hi, I have been in touch with Kerobo Claims since February 2010, they have taken £650 from me via my credit card and guess what i am paying my credit card back as they threatened me with court action, Kerobo kept avoiding my calls and emails, si if i was you leave well alone, my credit card bill is larger thanks to them.:(:(:(

    Had Kerobo told you they would wipe you credit card out by any chance and to make their payment via the card also and then stop paying? I ask this because you said "guess what I am paying my credit card back (which is usual to most!!) as they have threatened court action??? I take it you have complained to them? They have recently lost their MOJ authorisation and MOJ have left a statement here

    Don't know how you can actually get your money back now but certainly I would contact MOJ to see what you can do.
  • Well we seem to be in the same situation, what you have received is a carbon copy of mine really, Im trying to find out where to go with this, they have over £2000 of my money. I think we have been scammed but ATM seem to be quite helpful but now appear to be trying to close the case. Any help would be useful

    I have been dealing with Kerobo and ATM Solicitors since Jun 2009 and have been following this thread for the past 6 months. I haven’t really needed to add anything until today as I have received a demand from and Insurance company for Legalcare Protection Policy and Disbursement Protection Policy. I will try to tell my story as best I can with a chronological list of events. Apologies if it is very long winded!

    Letter received from ATM with copy of conditional fee arrangement and I was advised the will now take initial steps to commence the claim.

    Letter from Kerobo – case against MBNA has been accepted by ATM Solicitors

    Phoned – and a I was called me back. ATM had received the documents back from MBNA and a letter was in the post to me.

    Letter received – breaches have been found in the agreement and a revised letter had been sent to MBNA outlining these breaches.

    I phoned and was advised ATM were in the process of applying for after the event insurance (the After Event Insurance Application was signed by me on 28 July 2009)

    Letter received from ATM – have received a letter from MBNA denying any liability. They advised me in the letter “I have responded informing them that we are issuing proceedings. We are awaiting approval from insurers before we can further your claim.”

    I phoned. I was advised they are still waiting after event insurance and when it is approved they will let me know.

    Phoned again – still waiting after event insurance.

    I phoned again – still waiting for after event insurance which was applied for on 8 April 2010.

    As per tel call to Natalie Clements, the insurance is now through and they are waiting an expert opinion (from a Director) about issuing proceedings. An audit report (about breaches) is due within 1 month.

    Letter received from ATM Solicitors to advise me of the outcome of the recent “test case” hearing which took place in Manchester. The advised me that and Appeal seems the most likely course of action and it is estimated it would take 6 months to receive a final decision from the Court of Appeal. They also advised me they are exploring other avenues of the claim and will continue to keep me updated.

    Letter received from Ultra Insurance Company Ltd. Demanding payment of £577.50. States Legalcare Protection Policy and Disbursement Protection Policy was issued on 1 October 2009.

    The letter states that “the balance of the premium due in respect of the policies namely the sum of £577.50 was due to be paid either (1) within 7 days of your case concluding or (2) on the 25th September 2010 (i.e. 360 days after the issue of the policy) which ever first occurred.

    A copy of the proposal form is attached to the letter from Ultra Insurance, which I have never seen before and has NOT been signed by me. A copy of the After Event Insurance Application is also attached, which was signed by me on 28 July 2010.

    I have never seen the policies and as per my notes above, according to ATM Solicitors, the after event insurance wasn’t received until around July 2010.

    According to the letter from ultra insurance – insurance policy was issued on 1 October 2009 and £52.50 was paid and allocated. I certainly didn’t make this payment.

    I would really appreciate any help or advise on this. I plan to get onto ATM Solicitors first thing on Monday morning.

    I have too been scammed by Kerobo. In fact I recently got a CCJ from the county court against Kerobo and they have been ordered to refund me my deposit plus my court costs. Unfortunately 10 days on and surprise surprise no refund.

    I have looked on the Companies House website and the same company number exists for Kerobo limited. This address is

    In fact I recently got a CCJ from the county court against Kerobo and they have been ordered to refund me my deposit plus my court costs. Unfortunately 10 days on and surprise surprise no refund.

    You will probably never see the money. Since they were closed down, they probably have little or no assets in the company and you would expect them to be in administration any time now.

    Would that be the same credit card company helping you get the money back as the ones you were paying Keriboo to avoid paying???
