  • Can anyone advise?

Took out old style pre 1998 student loans regulated under consumer credit act.

Sadly bankrupt in 2004 & lost everything.

Have had no contact from anyone since then regarding loans. Received a default notice from HSL in Nov 2012. It quotes section 87 consumer credit act.

Wrote back to them saying i owed no money & that matter was statute barred.

Received a reply this week saying that there is apparently a CCJ from 2003 and thus this is classed as sufficient action to prevent statute barring.

Given no previous contact & a claim of a CCJ that was 10 years ago, where do I stand?

Why have they sent a default notice if they have had no contact or agreement in place with them?

If this apparent CCJ is classed as sufficient action, why was it not their position from when they contacted me in Nov 2012?

I have not acknowledged the debt, can they enforce anything?

    Any help appreciated

I posted this in the 2012 discussion thread but think it might be better placed here:

Hi all. I have a question about loans that I have been deffering for a long time. I have never really been a position to repay until now for reasons I won't go into but suffice to say these are loans going back to the mid-90s.

I am just starting to get back on my feet financially and have a secured a job that comes with a car user allowance. Without the allowance my salary is way off the thresholds but with the allowance it comes very close and a small pay-rise would push it over. Are car allowances counted when they are calculating how close to the thresholds you are? The allowance is an absolute necessity for the job with nationwide travel.

A car allowance would be a taxable benefit-in-kind, and therefore count towards the income figure.

Thanks for that and gratz on your 2k posts :)

Financially the move into this job could leave me worse off by quite some way. Going to be sailing pretty close to the wind after my probation but I guess the gross monthly incomes may rise in April.
  • Hi, Can anyone enlighten me on my eligibility for student finance please? I started a degree in 2009/2010 but i didnt return for the second year. I now wish to take a degree course but am unsure whether i will get funding from student finance England? I can only find general info that gives no definite answers. Does anyone know if i will qualify?

    Many thanks.

    :)

If you've only been in attendance for one academic year, you'll be eligible for the duration of the new course. However, should you fail a year, you'll lose entitlement to a fee loan for the repeat.

I took out a student loan in 2001-2004.

I worked P/T for four years after graduating but then an ongoing mental health problem got worse and meant I was unable to keep working. I've since been supported financially by family until last year when I applied for ESA. I was denied the benefit after the assessment phase, did not appeal and am now again supported by family with no other benefits.

I got a letter from student loans company saying I have to provide proof of circumstances so they can determine if I have to pay the student loan back. Well, I obviously have no income at all but if I say I'm financially supported by my parents will they be liable to pay?

    Thanks for any responses.
  • Hi I'm in a bit of a predicament. I've previously done 1 year at Uni and left it. I've now started a 4 year sandwich course and applying for student finance went without hiccup. Now half way through my second year I (really) wish to switch to a different 3 year course at the same university. I've been considering it for a while and the only thing I'm concerned about is the student finance. I know you get financed for the duration of the course + 1 year - any years done previously. So I applied originally for a 4 year course, now switchting to a 3 - will that make everything work out ok? I know that the 3rd year placement is a reduced loan though so will that mess anything up?

I also have a child and get more than 1 grant - will these be affected?

Also, if I did need to fund the final year myself, could you give advice on the best way to go about this? Would I need to apply for some sort of bank loan?

    Thank you

    Dan

Your new course is 3 years.

duration of the course + 1 year - any years done previously

    so 3 + 1 - 3 = 1

You will only get funding for 1 year and it works backwards, so you won't get funding for Year 1 or Year 2 but you will Year 3. Not quite sure why you thought moving from a 4 year course to a brand new 3 year course would make it fine.

You won't get a bank loan. Or any other loan in fact. To get a commerical loan you need to show you would be able to pay it back, which without a job you can't do.

Any grants you get would need to be paid back should you drop out before the end of the year.
  • Hi Taiko

I was wondering if you could help me (again) please?

I have been trying to claim CCG for 1 day per week since september, up until now I havent recieved it yet, first it got lost, then recieved again (but not until dec) and the lastest advice was that the forms were filled in wrong from the nursery, but when I quiried this the advisor could not see what part was not filled in, I have now posted in the forms for oct - jan but the same member of staff at the nursery has filled them in again and they looked the same as the first set so I am concerned that these will also be refused.

I just need to know which part was not filled in that needs to be so that I can get the forms resubmitted as although the fees are low (just £35 a week) I am struggling to keep paying these fees

    Thanks
