    My Approach would be the following,

    Step 1. Work out to the day when the 8 weeks from the first letter is up.
    Step 2. Send the "Letter 2" (similar to the one above in bold) but worded to your scenario (im happy to help you write it via PM if you like) make sure that instead of giving them 14 days you give them the xxx days reamining from the 8 weeks,
    Put bullet points to back up your claim.

    Did you arrange the loan via phone? if you didnt then they cannot prove that you were aware of the PPI being present. if you did then you can suggest they find the call and listen to it, as it will prove you were persuaded to take it.

    Hoep this makes some sence. but remember "DO NOT GIVE UP"

    Got a reply from Lloyds offering £1714 + interest + 8%

    i accepted and have since recieved the sum of £2610 :-)


    Still awaiting my CC monies but this is a great start.

    Hi, I am new to this forum and wondered if I could get some advice on dealing with the not so wonderful Lloyds.

    Back in Feb 06 we got a personally loan from Lloyds and was told that we had to take the PPI otherwise the loan would not go through. We have now since found this to be untrue. However due to my husband being made rundandant and other personal circumstances at the time we got into difficulty paying our monthly payments. Due to my husband finding another job rather quickly the insurance didn't cover us. Arrears racked up and Lloyds themsleves advised us to go to the CCCS. Which we did so. Llloyds accepted the DMP, but wrote to tell us they would keep racking up the arrears and would put us on a special higher rate of interest for those like us who couldn't pay. They're also refusing to cancel the PPI which really is of no use to us as my husband would have to be out of work for 12 weeks before we could claim. Not very practical with a young family. We have now got to the point where our debt is going up instead of down and they are threatening to sell on the loan, which has resulted in Lloyds in house solicitors phoning me several times a day on both my home phone ane mobile. This is dispite repeated written request that they contact me via letter only.

    I have contacted solicitors over the PPI and have been told that since my account is in arrears they will not take the case on as Lloyds will use what ever we are awarded to pay of our arrears.

    I really feel stuck in the middle and it seems to me that Lloyds are going out of their way to make our financial situation worse.

    Whenever I write or phone Lloyds apparently no one deals with this and they will send the letter/transfere my call to another person who doesn't deal with it.

    Any help and advice most gratefully received

    You can try to reclaim this free of charge with help from this site and free templates etc.

    In regards of reclaiming on the ppi, they have 8 weeks to respond in full.
    You can still try reclaiming on this whether on DMP or not, if successful it may however help to clear most of the loan etc.

    Hey peeps, regarding Lloyd's being a pain in the backside with ppi claims. This is true, however with a bit of persistence they do refund in the end. Sent all the letters as instructed to do, got all the usual replies blah blah blah. They sent a letter saying how sorry they were that they exceeded the eight week time limit but that it was taking longer than expected to resolve my complaint. So I sent a final letter to them stating if they did not come back to me with a final response in my favour within 14 days then I would take my complaint to the FOS(which I had already done anyway;)). Within 5 days got a letter from then offering a full refund of just over £1700 plus interest. Had to phone FOS and cancel complaint and even they sounded surprised they had paid up seeing as the FOS hadn't even contacted them regarding my complaint. I'm aware I may just have got lucky but it is worth a go!:beer:

    Have saved over £8000 using this site over last few months, thanks MSE!!:j

    Thank you so much for your great advice.

    Yesterday I actually found a firm of solicitors willing to fight in my corner. Apparently threats to use what ever is awarded to pay back my arrears is a usual bank trick which the solicitors are used to. They simply request that any award be paid into another account. Not a problem since I no longer bank with Lloyds.

    I had tried to claim back my PPI myself, however Lloyds gave me every excuse in the book as to why I couldn't claim it back and since the FOS had ruled in their favour over a complaint to do with fraud on my credit card I wasn't confident complaining to them again.

    Wednesday we shall start the claim rolling, so with any luck in 4 - 6 months time we shall get somewhere.

    I heard from the solicitors today, I should be receiving my letter of instruction in the next few days. We have decided to go this way as Lloyds is threatening to use what we're awarded to pay the arrears on our loan. Arrears we wouldn't have been in if we were aware that we didn't have to take the PPI out.
