    That's through data protection isn't it?

    I'm a bit worried about trying to open a bank account tomorrow given my current account is in arrears in this way. How do I make sense of it to another bank? So many different things to think about, my credit rating, trying to stop them from applying more charges.

    Regarding people watching pins go in - I still have no idea how someone else got my PIN but I'm trying hard to find out.

    You are better opening a bank account sooner rather than later as it takes a bit of time to mark someone's credit file.

    For more information about a Data Subject Access Request go to http://www.ico.gov.uk/

    And a tip from someone who has done a few of them is to alter the standard letter to state:
    1. You have enclosed a cheque for £10 payable to [state the company name] which is the maximum fee applicable under the law.
    2. State the cheque number of the cheque enclosed in the letter.*
    3. Enclose a photocopy of your driving license or passport and state you have done this as well as including your account number.
    4. Include a day time phone number in your address details - as some data controllers will phone you up to ask you exactly what records you want.

    This means they have exactly 40 days from the date of receiving your letter to comply with your request as they can't:
    1. Take a month to write you a letter asking you for £10.
    2. Take a month to write you a letter asking for more means of identifying you.

    The request must be sent by at least recorded delivery and you are only allowed to do one once in a reasonable time frame. This time frame is not stated under the law. So you are actually better of waiting until you have waited 6 weeks after you have put in your "Formal Complaint" before doing one.

    *The cheque doesn't have to come from your bank account. However if it doesn't write the sender's (your) name and address on the back of it.
    I'm not cynical I'm realistic :p

    I doubt your credit files will be up to date enough for any of this to have been registered yet. If you act quickly, there will hopefully not be any issues.

HSBC is unlikely to have a sudden change of heart at this stage. It would surely be best to escalate this upwards as soon as possible?

    Fair enough, my worry was that the OP has nothing concrete to complain about at present - she can't prove what has been said to her verbally, and the bank may deny that they have finished their investigation, deny that they blamed the OP ...

    She can however show that she was not refunded and that the bank did not follow the procedures they should have.

    Hi Angela

    I am going through the same with Alliance and Leicster and recieving the same responce, my card was stolen and used with the pin I lost £2,500. They even used my card and photo ID to take £500 from the branch of the A&L, but this has been refunded (strange) but i an still out of pocket by £2000. I have reported it to Which as James suggests, and have only dealt in writing to the fraud investigation team recorded delivery. I will keep you posted of my progress,

    If the press get involved I bet the bank will amend that sentence to:

    "She can however show that she [strike]was not[/strike] has not been refunded YET and that the bank [strike]did not follow[/strike] have not YET exhausted the procedures they should have."

    Or maybe I am being a little too cynical?

    Awful, it's just unbelievable, all of it. Please let me know how you are getting on. I really feel for you, it's just so insulting for the banks not to deal with this properly. The call that I had from the fraud team on Thursday was the most demeaning 'conversation' of my life. They asked me if I'd been out that evening to eat and drink, or just to drink, accused me of being hazy on events because I couldn't tell them what taxi company I had a lift home with and couldn't pin point when or how my card was stolen. Well, had I known it was stolen straight away I wouldn't have been in this mess! They'd ask me questions then put me on hold for 5 minutes or more then come bank and repeat the same questions. I understand they have their processes but this was just awful I was in a mess afterwards and thankfully I have wonderful bosses, one of whom spent half an hour calming me down and reassuring me.

    I joined the Bank of Scotland, obviously now HBOS, when I was around eleven years old as a Super Saver (kiddy account). I've never caused them any trouble, I've been a good customer and this is how I'm treated at the first sign of a problem. They've given me no advice or help on what to do and they've blamed me for what's happened. They told me I need to go to a branch to sort out a new overdraft (or loan?!) facility to cover the 2254.66 plus charges that I now owe them. And they've sent me yet another charge notification.

    I went to the Citizens Advice Bureau yesterday and they were really helpful - they said I was so on top of things that I could pretty much go and work for them. I did admit that was due to all of the advice on MSE forums!

    In the meantime my wages are safe, I have another account thank God and was told that my credit rating is perfect. Good news, will have to stem the effects of this debacle though.

    I've managed to get HBOS to stop applying new charges to my account for the next ten days only. One of their collections team tried very hard and to push me into "taking out a facility" to pay them back almost £1000.00 to cover the unauthorized overdraft that I am in because my card was stolen. The woman I spoke to actually said "HBOS don't pay out on chip and PIN claims" and said that to have such a theft on my card I must have been negligent. The nightmare continues...
