  • Asda has CCTV evidence too! Using Google Street View I found out that there's a CCTV camera at the ATM they used also. Three sets of hard evidence are available. Now the police are really keen to work on this...BUT according to them my bank haven't reported any crime so they're 'hamstrung' by that.

Next step, back on to HBOS to force them to report it - no wonder they couldn't give me a crime reference number. They don't have one!

Going to the CAB and to the local branch of HSBC to see about opening an account with them.
  • BUT clock is ticking on the CCTV - only valid for 16 days total, I've got until next week. Argh.

I really think you need to get WatchDog involved to show how ridiculous it is that this is what the bank should have been doing NOT you.

I think with their involvement the bank will back down and re-imburse you if not compensate you as well.

I still think someone who works in the club is involved
  • The police are being fantastic now, have just had a call telling me they're sending CID to retrieve the CCTV evidence so that it can be stored by them, preventing me from being in the situation whereby I don't have any visual evidence.

Also, having called the fraud team - yes, me calling them, again -they have confirmed that they are going to 'interview' me over the phone tomorrow to come to a decision. They say I'll know that decision by tomorrow PM. The chap that's doing it sounds rather clueless so far. They say it's just to get my 'opinion' on how this is a fraud case. Dubious doesn't cover it.

Socrates, I think you might be right - about everything! I'll see what tomorrow's 'interview' brings and take everything on from there.

Don't forget to keep note of your time and expenditure on this issue so that you can include those details if you make a formal complaint.
  • HBOS carried out their fraud 'interview' and have now told me that I'm liable for the £2256.00 overdraft plus £133.00 charges.

You've done very well to get all the evidence you have done. Have the police provided you with a reference number? I'd send this to Halifax. I'd also write a formal complaint letter to Halifax, demanding that they refund the money as you clearly aren't liable.

Nooooo that is terrible, have they even reported this to the police yet.
How can they just ignore the evidence?
Personnelly I would protect yourself and get any wages paid elsewhere (you may need to open a current account at another bank). I would put the whole thing in writing to the bank as a complaint so you can then pass it to the ombudsman. I would also tell anyone who will listen, watchdog, papers etc.

Also push the police aspect if possble, if someone gets prosecuted for this the bank wouldn't have a leg to stand on.

    good luck
