Now there is a surprise ... (not)
Time to get the media involved - perhaps contact the reporters involved on the stories already quoted - direct them to this thread - it will explain the whole story in a nutshell.
They will particularly like the investigative work you have done - it will make for good reading.
Do not give up !!!0 -
I won't give up, no way. I've done nothing wrong, I don't deserve this and neither do all of the other people that have to deal with this sort of shoddy treatment because of the "chip and pin" get out. They said I didn't have any reasonable explanation of how someone could have gotten my pin so they won't pay out. How ridiculous.
I'm going straight to the Times and to BBC 4's money box.
The bank didn't care about the evidence I'd gotten, that's between me and the police they say. They say the only way I won't be liable is if I can get a prosecution!0 -

I expect they will have a specific appeals procedure for decisions made where the customer has claimed that there is fraud on their account ... make sure you find out how to go about making an appeal.
If not, there's always their normal complaints procedure.
Good luck!0 -
If you haven't done so already (sorry haven't read every post) I would make sure you open another account ata different bank and transfer all your direct debits and any incoming salary into that. Don't allow the bank to keep your business.0

Angela are you 100% sure you put your card away and was then pickpocketed? Is it possible you were distracted at the bar and only put your receipt away? If so it's more likely to be a member of staff involved, well worth asking if the bar manager is willing to view some of the CCTV footage at the police station. Also ask if they have their own CCTV footage of the night in question so you can match up punters with criminals.
Local press also like stories of this nature - the bar and the bank won't want bad publicity so may be more proactive, and the police may be willing to release release stills from the CCTV, meaning the criminals may be identified.Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0 -
We have the time of the transaction, the chip and pin machine number and the police are getting CCTV from the Bar tomorrow...matching up with the ATM, Argos and Asda we can hopefully prove everything.0

Angela - I'm just curious - did you quote all the stuff about the Consumer Credit Act (from page 1 of this thread) to your bank?
You are in your overdraft because of this fraud - it shouldn't matter about chip and pin ...

Angela,
I've only just found this thread, and I really feel for you, I've been a victim of credit card fraud myself, but it was all handled smoothly and easily with no chasing on my part- nothing like this.
I really hope you get a good result soon, sending good vibes your way,
MrsB.
It's only a game

Yea, I did quote the Consumer Credit Act, the response was along the lines of 'what's that got to do with anything?'0 -

Well - I honstly think that, if they don't refund and sort it out, is going to be your fall back position, because it has *everything* to do with it. It is only valid for them to ignore that if a) the fraudulent transactions weren't in your overdraft, b) you made the transactions or c) you gave your card to someone else willingly to make the transactions.
This is the posting I made on the subject a while back following an email conversation with the financial ombudsman:
http://forums.moneysavingexpert.com/showthread.html?t=372881
However, I just want to inject that, while I appreciate your finanical situation - you are only 3 working days beyond your original posting, which was a week after the original fraud. So having a resolution in 9 working days (remember the bank holiday!) would be very good in most of these kind of situations.
But I wish you luck with your challenge here.0
