  • I sent an email to my MP yesterday morning. This morning I got a letter through the door saying he agrees that HBOS are acting unfairly and that he'd written immediately to the Chief Exec of HBOS on my behalf and that he'd be in touch upon their reply. I needed a boost like that, was beginning to feel like I was never going to get anywhere!

    Hi Angela,

    I've been following your saga, and hope it all comes to a satisfactory conclusion.

    Just a quickie, have you written to HBOS to formally hold the account in dispute? If you do this they will not be able to report the debt to the credit reference agencies or pass you onto a DCA.

    Include this paragraphs somewhere in your letter:

    "You can not issue a default notice on this account, nor pass the debt onto any third party. Furthermore you may not pass any information regarding this account onto the credit reference agencies. To do this would be in breach of Section 13.6 of the Banking Code."

    Angela, I've read through this topic and feel your anger and frustration. Big respect for fighting your court though and I wish you the very best in resolving this and getting your money back. Banks can be complete scum sometimes.
  • Still waiting on more information from the bank. I had a missed call from someone at HBOS on Saturday morning but they didn't leave a message and I haven't heard anything since. All very quiet, which seems strange.

    Fraud unit on the phone now, trying to say that my bag wasn't secure!!! Well, they keep questioning me about that, which in a way I can understand but it feels like they're trying to push me in to saying that I wasn't keeping my card secure.
  • And after all that HBOS have just confirmed that they're going to reimburse the money. Thanks so much to everybody for the help and advice. I have to admit that there have been lots of tears, so much anxiety over this and I don't know how I would have gotten through without people here being kind and taking time to offer advice without which, I really don't know how far I would have gotten. Thank the heavens that on this occasion HBOS have done the right thing.

    I'm pleased you've got it all sorted. I've been following this carefully and think the way you've been treated is awful. Many people would have given up at the first hurdle but you kept going as you knew you were correct.

    Once you have got the money back from them, I'd definitely push for some compensation to cover all the time and effort you put into this. You had to do so much work that HBoS or the police should have been doing. Perhaps a letter to the complaints department is in order?
