Are you still paying the mortgage? If so then you still have a right of access to the property...

Surely there's caveats to that. You don't have unrestricted access if your property's occupied by tenants or squatters, for instance?

regarding the mortgage id suggest taking him up on the offer if its in negative equity , get out now .. and dont speak 2 him again simple as ;)

I think you're right about tennants/squatters, but in this instance I doubt that would apply - the house is jointly owned and one of the owners has arbitrarily denied access to one of the other owners without any kind of agreement/arrangement in place, I seriously doubt he could claim to be in the right in this instance. (I am definitely no expert though!!)

    Mortgage-free Glee!
Interesting thread, and an excellent post from neas. Nothing more to add to what he's already put except to congratulate you on getting away from this situation relatively scot-free.

However, make sure you get everything signed and then checked by a solicitor. Make sure you get confirmation from the mortgage lender that you are no longer liable for the debt and no longer on the mortgage.

Then laugh your a rse off that you've just walked away from a mountain of debt and left your ex well and truly in it :D

Please resist the urge to gloat about leaving him 'well and truly in it' until you have confirmed that you are off the mortgage!!!

    p.s. I'm male and in my late 30s. ;)
