    If you have a joint mortgage then the deeds will be in joint name as well which means you have every right to access the property.

    If you cannot afford the mortgage payments, your ex is still liable for 100% of the repayments. My advice would be to consider forcing a sale and recouping your funds. If your ex doesn't want to move out then his mate can apply to take your place (effectively buy you out of the mortgage).

    Either way, the house is still partly yours and I would contact the authorities if he fails to cooperate.

    In England if you are legally resident (not sure about owner) of a property and THERE IS NO ONE AT HOME you have the right to entry, even if this means forced entry. I agree with everyone else on here though, you should be focussing on getting your name off the mortgage. You are paying out money each month you are not going to see back, and if the property were to be sold you would owe the mortgage company money. How deeply is it in NE? I would seriously consider just paying the fees to put someone else on the mortgage instead of you, you would rid yourself of the portion of the NE debt for a relatively small cost, be rid of the hassle with your ex, and you could stop throwing £300 a month into a property you are getting no value from.
