you dont get the choice unless delivery to the UK is going to be after 1st september. There are so many cars coming through at the moment, they are being turned around quickly once on dockside,. there are no facilities for cars to be delayed/stored, just so you get a different reg date/plate

Thanks for the reply - as I say I have no issue on anything else with regards to qualification apart from:

Does the fact it has been failed, even though the old one is still valid exclude it from scrapage? A lot of people MOT before the expiry date so I would have thought someone would have experienced a failure and decided that rather than fix it they would go for scrapage. Has anyone doing this had success?
Edit: Sorry was writting my reply to your first post when you wrote your 2nd, would be interested to hear from someone who has done the scrapage.
I should also say that although the garage said it was okay to drive, it did fail on 3 dangerous things, main one being one of the back breaks not working (they said it would be okay for local driving, just don't go above 30mph - would the fact it failed with dangerous failures affect the whole scrapage as well?)

A car that has failed it's MoT is ILLEGAL to drive on the road (apart from taking to a booked MoT test). You are also invalidating your insurance.
If you continue to drive around you are incredibly stupid - have you no thought of who you might injure or kill, and if you do you will be totally responsible for the consequences. The garage that said you would be okay to drive around with defective brakes should be reported and closed down immediately.
Having said that you can still use the old MoT for the scarppage scheme if you order the new car within 14 days but DO NOT use it anymore.

as long as the new MOT was post-dated to the expiry date, then your old MOT would still be valid
if the date on the MOT certificate is the same as the day it was done, then your car no longer has a valid MOT, as it has been superceeded
It would only be illegal to have the car on the road in situation two. However, if i was told my car was illegal to drive (ie situation one), i dont think i would risk driving it
However for scrappage scheme, they do not check the MOT database, they just need to see a valid MOT certificate, which you have

Written on the back of a MOT failure cert,
"If you intend to use your vehicle on the road you should have it repaired without delay and have it retested before the existing test validity expires"
So you can still legally drive, depending on the failure. My cat failed on a blow at an exhaust flexi joint, no risk of the exhaust falling off. I booked the car in for repair & was told it was safe to use untill then, so I carried on driving it.
I'm not sure about the new electronic MOT, but on the old failure sheet there used to be a section the MOT tester could fill in to say the car is dangerous and shouldn't be driven on the road untill repaired.
If you were to have a accident with a dangerous fault, like in the post above, then you could be prosecuted for dangerous driving (driving a vechicle with the knowledge of a dangerous fault)Next year we'll be millionaires!0 -

Hopefully they wouldn't, worth asking though. When they informed me my car was ready, they already had the reg, so just waiting for that phone call may mean you'll still end up with a 09 plate, again best to ask.Next year we'll be millionaires!0 -

they wont give it to someone else, its registered to you, so unless you cancel the order, and loose your deposit, then the car is yours, no matter when its delivered
Reg date would have been agreed at order time, and the price you pay will reflect which quarter the sale falls in - you want September reg, you wouldnt get the same discount as someone who was prepared to pick-up their car in August.
Scrappage cars have no sales incentives, so you get the car, when you get it, no option on reg dates. Tbh, most manufacturers are trying to rush them through, so they dont have to pay storage costs, or delay getting their money back off the government, so once it hits the UK, you usually get it quite quickly

when did you order, and was this agreed at time of order? if so, that was the dealers choice. It usually cant happen once all the paperwork is in place, and if it does, its usually because the dealer has balls'd up somewhere, and the car wasnt ordered when they said it was, so thats put the dates back - makes them look good too

I ordered May 27th. He rung me and said it would be due about mid August but did I want to hang on for the 1 September reg and I first thought, no, Ill have it asap but then I realised the possible increase in its resell value and when he sent me the order to sign and return I emailed and said Yes, I wanted to hang on to 1 September. He asked if I wanted a personalised number plate, I said, nope and that was it. Oh its VW0
