No Interview and got IPA Today

Hi All,

I went BR in RCOJ on 30/3/09 for £53,000 and didn't need and Interview, they felt there was enough info on my reasons for BR on forms. Today I got my IPA letter to say to pay £173 PM for 36 months on or just after 18th May onwards. The only thing is that I don't know what was disallowed on my SOA but hey I count myself lucky as it is far better than struggling to pay £1,100 PM on loans. Also they didn't mention my car so I guess I keep? Here was my SOA

Income

Salary - £1853
Partners Contribution - £500
Child Benefit and DLA for Son - £469

Total £2822

Thanks to everyone on this forum who answered my questions/worries, I will continue to log on here every week - to be honest I am a bit addicted:T

Please remember they cant use child benefit for use of IPA and i dont think they can use your sons dla either, so with your figures you shouldnt have ipa, i would ask to see how they have worked that out.
  • I agree with NM ring your OR and ask for a breakdown n how they assesed your IPA. This is your money and you are allowed to challange and ask how they worked it out. When you get the breakdown pop it up and let us check it out.

  • Thanks my office is in London, I didn't know that they can't use DLA so as I had a surplus of about £87 after Child Benefit I just thought they cut back on some of my outgoings? So should I challenge it? How many people on here had childs DLA allowed? Oooh I'm a bit confused now......

  • looks like a easy way out of OR's work load . If someone chellenges so be it, if they dont they have got away with it
  • If the award is to your child it is not your income so does not count as your income.

However if you have any items on your I&E that are higher than normal due to the childs disabilaty, and they have allowed it, then it is fair to ofsett this against the DLA

So you have to be reasonable, but so do they;)

Thanks so what are peoples views on my SOA? If they counted my DLA as income I would have had a surplus of £87 and then if they cut back on allowances it would have had to go up to about £250 surplus to get a £173 IPA. If they didn't count DLA I would have been £252 deficit and surely they would not have cut back that much on my SOA £500 so I get this IPA. It is making sense now.Is there anywhere on Insolvency register to say they cannot count DLA for an IPA?:)

  • If it was your DLA, they could count it, it is not disregarded as it forms your income, but as the award is your sons, it is not awarded too you, its awarded to your son, not for anyone elses benefit, unless you get a care payement out of it, then that amount, and that amount only could then be seen as your income.

DLA is a bit of a minefield, but in simple terms it is paid to cover the extra costs of the disabilaty, so the theory is there should be matching expenditure to offset the award

In a DRO, for example, it apparently has been agreed to count DLA, then add an equal amount to cancel it out

  • Ps. to get an IPA of 173, you would need a surplus of at least 346

  • Thanks BAAB,

You have been really helpful I will have to "bite the bullet" and give them a call to see what was taken into account as income and what was allowed on my SOA:confused:
