    I do have some news. I have just received an email from my friend.

    and this is her feedback:-

    But look if you read the Q & A section, 5th question down, What are the regulations on tooth whitening products? You will see that it says here that it is illegal for tooth whitening products with over 0.1% peroxide to be supplied. The gels I am using don't have any peroxide in them. I have found out that when Sodium Perborate (the active ingredient) reacts with water it produces under 0.1% Carbamide Peroxide which is totally safe and non-damaging

    You would be better off getting advice from someone who specialises in medical negligence claims since the law governing illegal practice of dentistry can be quite complex.     Seeking legal opinion is very wise if you are even remotely considering investing in this very dodgy business.

    ps re your friends reply the prosecution was not over the product used (it wasn't even peroxide) it was the practice of dentistry.

    I don't think so read the link above posted some time ago but here's an excerpt if you don't want to read the whole thing

    Sodium perborate is a chemical which is currently permitted but that could soon change, as there's evidence that it could be toxic and have a harmful effect on reproductive health and the development of unborn children. The European Commission is working on a proposal to ban sodium perborate for consumer use - and that includes its use in teeth whitening products.

    It doesnt matter, I have read the article. and nowhere does it say what she is doing is illegal. It says sodium perborate is permitted, it states it MAY change but it hasnt as yet. My friend does not carry out the treatment on pregnant women or if they are breastfeeding as this is not allowed.

    So I would say that this is a small victory for me and my friend:j

    This is a copy of a paper on sodium perborate . http://ec.europa.eu/health/scientific_committees/consumer_safety/docs/sccs_o_031.pdf Interestingly it is absorbed into the blood stream via the mucous membranes (gums). This paper was analysing its use in hair dyes but the end point was that its current use (including denture cleaners) is dangerous and has effects on fertility and foetal health. Interesting when it is being applied to parts of the body where it is easiest and best absorbed. You said it is 100% safe, here is a scientific paper, one of many, which says it isn't. The EU is going to ban its use as have Japan and Canada (in cosmetic products).

    Even if you happily don't care what is going in someones mouth it is still illegal to put anything that whitens or cleans etc in a mouth unless you are a dentist.

    Here's an excerpt that should worry you

    Toxicokinetics
    From a study with human volunteers using mouthwash solutions it can be concluded that
    oral absorption is 100%. Sodium perborate is degraded to boric acid and H2O2 and is
    excreted as boric acid via the urine. It may be assumed, that several, if not all of the
    systemic toxic effects are caused by the degradation products. After dermal exposure,
    degradation at the site of contact may be less effective. However, due to the high catalase
    activity in blood, degradation should then occur in the blood. The absorption via inhalation
    of sodium perborate hydrates is assumed to be 100%. No data are available on the
    metabolism and the distribution of sodium perborate within the body. From investigations
    with other boron compounds, it may be suspected that elevated boron concentrations are
    found in the bones.


    ps not treating pregnant and nursing ladies won't help the men whose sperm quality may decrease and who may suffer from testicular atrophy.

    you are now clutching at straws. get over it!!!!!! for god sake, give it up! The gels DO NOT TOUCH the gums.

    My point is........ITS NOT BANNED AT THIS MOMENT IN TIME

    my victory is, as far as I am concerned (and alot of other people) my friend is doing nothing wrong.

    :p I am happy now, and I am not going to bother discussing this anymore.

    By the way if you read the paper above you will see the active component in the gel your friend uses is not sodium perboate or carbamine peroxide but the substance that both compounds break down to ...... our old friend hydrogen peroxide the stuff you say non dentists should be prosecuted for using. Indeed the paper above says for the purposes of legislation sodium perboate should be treated as hydrogen peroxide. So your friend is using hydrogen peroxide to whiten and depositing boron at the same time.nb sodium perborate produces 32% hydrogen peroxide.

    Also if your friend is painting stuff onto the gums to stop solution touching them or applying rubber dam etc that alone is illegal practice of dentistry.

    So now you know your 100% safe totally natural ingredient is in fact about to be banned by the EU ,has been banned by Canada and Japan, actually degrades to that active ingredient hydrogen peroxide which you said you wouldn't have in your mouth and said it was acceptable to prosecute non dentists using this.

    However it could have been the harmless compound you first thought and it still would be illegal for a non registered dental professional to assess and place it in someone.

    well, the last couple of days have been.......kinda fun. but, ive got a life to lead, havent you!? I wont be coming back on here anymore. As far as I am concerned its a small victory but a good one. You can go on all you want. sodium perborate is not about to banned by the EU, I read that the EU are TRYING, but its a long way off. Dentists need to get off their 'high horses'. salons, beauticians etc will still continue to do tooth whitening, whether its short lived, we shall see.
