Orange and E2Save Cancelling Offpeak Tarriff Orders

    Like i mentioned in a prevous post, it may be very unlikely that we will recieve our phone. e2save are giving conflicting advice. Customer service says 1 more week, apparantly 7000 w800i clearance phones in the ware house in london waiting to be sent out (told by customer service lady,to me), website says order is still being processed, get a email saying orange has refused to give me a contract, web services section of e2save say that the contract is no longer being offered by orange so they cannot process the deal

    NOW I CAN SAY E2SAVE IS IN A BIG MESS, AND THEY ARE LYING THROUGH THEIR TEETH.

    Here's the problem

    I ordered a phone through E2save found out they had no stock, so ordered another type of phone from them and it was delivered . the originall order was still live eventually they cancelled the original order, now i have received the original orderdered phone (now got 2 new phones), but when i go into my account for this item it just comes up with order cancelled it was cancelled on screen the day before delivery, ( ist phone deliverd displays delivered)

    Now i'm sure one of you money saving people have came across this will the contract on the phone still stand, or will mabye i get a freebie from this,,, never ever get freebies so not holding out much hope

    Was it contract or payg? If contract:

    It may well still be live so don't count your chickens - your best bet is to check if the contract sim that came with it works or not, if it works then the chances are they passed your details to the service provider so you will still pay!

    I had the same problem when i ordered a phone withthem earlier. But unfortunately it was not a freebie. They had both the contracts alive, although their website was saying it was cancelled.

    If your extra is a w800i, i will be interested in taking it.

    Two days ago, I posetd that OSPS CS told me that all k750i clearence were sold out and they won't even bother to ask for my order no. :eek: I think that was what they being trainned for these days. :confused:

    However, I just received my k750i today (in mint condition). :j
    It comes with the every accessories (including 64MB memory and its adaptor, USB data cable, phone manual and CD) except for the handsfree kit (headset). :rolleyes:
    I phoned to CS and asked for it (some received after the phone call nearly two weeks ago) and they told me to go and buy it from CPW :(

    So, I owes an apology for OSPS for what I posted before. :p

    Finally, I hope OSPS will give out all the orders received before they increased their price. For me, I ordered before OSPS increased their price. ;)

    As most of the ppl received, I also received 4MB of Orange world (which I didn't ask for) :mad:

    However, for my w800i clearence from e2save just received a mail from them and saying that "Unfortunately due to the unexpected demand for this tariff Orange have withdrawn this tariff and as such we are unable to fulfil this offer to you." :(

    I also got the car charger as OSPS adertised in their web site for K750i clearence deals. :T

    Here's what happened to us today with OSPS.

    My wife's just waited over 2 weeks for a gold nokia 7370 on off peak 1000 from onestop, 10 months free.

    The phone arrived today, unbranded, unlocked and brown, not gold.

    I thought that was a result as it's unlocked, it's not been hobbled by Orange, and the gold one is really tacky, but her heart was set on a gold one.

    She phoned onestop to ask them to swap the brown phone for the gold one. They refused. Said if she wanted the gold one she would have to pay £6.99 a month.

    Might be worth reporting it to the Advertising Standards Authority and Trading Standards as it is not as advertised and is misleading. (Unless it said colour varies).

    If they accept your order though and email you a reference number, aren't they then under contract to deliver?

    That "could" be deemed as acceptance of your order but if they dig their heels in you would need to take legal action, with the risk of losing.

    However if they have debited any money from your account then they have accepted your offer to buy and entered into a contract with you. If they then want to back out both parties have to agree and if you don't they should replace the item with a similar one. If not you could go to the small claims court and sue for loss of bargain. IANAL but it's how I understand it. Hopefully someone with more knowledge of retail law can fill in the gaps! :)

    They do take 1p out of your credit card when you place a order.

    Mine came today too. Was quite a surprise as I thought I was supposed to get an e-mail saying when it was going to be delivered. Ordered on 6 March, so I wasn't v. hopeful, but it's good as new, has charger, 2x64MB memory cards and one adaptor, USB cable, car charger, manual. Only thing I haven't got is handsfree set, and that's not a big deal, except it means I can't use the radio at the mo.

    Maybe they are rolling them out slowly. Hope you all get yours.
