    I have finally been refunded...here's what you need to know and what you need to do!

    I spoke with the police in Nottinghamshire, don't bother, it's a civil matter so you need to phone Trading Standards.

    Trading Standards advised I let Chris know, as I did via email that he is in fact in breach of the Consumer Protection Distance Selling Act 2000 and I gave him a deadline, 3 days to process my refund or I would file in small claims court.

    Chris's response was that I should file as I wouldn't have my refund within the time I gave him, that is after I had waited months already so I filed a claim on line at the following link - it's easy and only takes a few minutes to do.

    I wasn't able to post the link so go to Money Claim Online, type it in google and you will be all set!

    I put in the money I was owed for the product ordered plus the £5 that Chris said would be coming my way for the inconvenience caused and the court fee of £25.

    Once you file the claim, email Chris and tell him you have done so, well, that is your call but I had given him every opportunity before doing this, I filed, sent him the reference number given once my claim was submitted and got an email back straight away asking for my pay pal account.

    I was then refunded the amount of my product, not the £5 or the fees with paypal and Chris was very rude yet again.

    I then withdrew my claim in time and have promptly received my £25 court fee refund from the court. You file and have until 9am the following day to reverse your claim but you need to verify that for yourself but yes, you can get your fees back if you act quickly.

    Unfortunately it had to come to this but it worked and I am rid of the Perfume Emporium for good, a true scam. I also filed a complaint with Chris' hosting company but they just referred me to the police so that was useless.

    File a claim today, don't delay and let Chris know you will be doing this, let him know he is in breach of the above, give him a date, only a few days and then tell him in the same message you will file a claim in court if the refund is not received by the stated deadline then file straight away.

    It is now October 8th, and I have been waiting almost a month for delivery of goods from the scam that is the perfume emporium. I since found this thread and can see that this has been going on since early March 09 if not earlier. I am just sorry I did not research before buying. Shame on me.

    I have requested a charge back from my credit card issuer. This means a load of form-filling I can do without.

    I have contacted SagePay and had no response. They should not allow this company to continue trading. As an e-commerce developer, I am frustrated that this has been allowed to go on so long: it discredits our industry and erodes confidence. Shame on them.

    At least Matt of United Hosting did the right thing and kicked them out.

    I have spoken to Trading Standards and they have recommended that as many people as possible file a complaint against this company. Regardlesss of whether they are actually breaking any rules, they are bending them too far and their are laws in place to bring them down.

    So PLEASE if you have been affected by this, call Trading Standards and lodge a complaint.

    I too only wish I had read the reviews about this company before I had any dealings with them
    I have been trying to get my money back from "Chris" since 13th August 2009!!!
    I have received every excuse under the sun from this crook!!
    Today was the last straw. He advise I had to wait 140 days for a refund.
    I contact Trading Standards who have advised that under the distant selling regulations (2000) after the order has been cancelled they have 30 days in which to refund your money.
    As I have constantly chased Chris for the money, Trading Standards have advised me to write Recorded Delivery giving them a 7 day deadline in which to pay up.
    I they do not Trading Standards will investigate on your behalf.

  • Just an update to say my order finally arrived and I have also been given an apology from Chris. He says he is still having a lot of issues with Royal Mail.

  • Today I received my money back from The Perfume Emporium so DON'T EVER give up.
    If you persist, Chris will eventually refund your money.

    After numerous emails to this company I contacted Trading Standards. They advised me to write, Recorded Delivery, giving them 7 days in which to refund me. If they did not respond in this time then Trading Standards would investigate on my behalf.

    I actually wrote "Special Delivery" as this guarantees delivery by 1pm the following day and the recipient has to sign for the letter.

    Amazingly, as my letter quoted that they were in breach of the Distant Selling Regulations Act (2000), Chris wrote to advise that the money had been refunded to my bank.

    The whole process to recover my money took 3 months from when I first requested the money.

    I emailed Chris every single day but I have to say that the Special Delivery letter did the trick!!

    I will never deal with company again. If this experience has taught me one thing it's to read all the reviews about an internet company before you have any dealings with them.

    AVOID THE PERFUME EMPORIUM - THEY ARE A SCAM!!

    After initially ordering mid June and chasing Chris frequently since then, I have finally been refunded.

    Like most other people I had the "royal mail lost it, need to wait 15 working days" story, then had the 30 days to process the refund story before finally having the "refund due in 71 days story". I had previously threatened to take him to the small claims and trading standards but nothing changed. Also had said I was going to report him to his hosting provider but that was just before he moved anyway.

    Finally spoke to Conumer Direct and they said to write him an email regarding the distance selling regulations and threaten him in the letter with a refund within 7 days or Trading Standards would be involved. They also stated to send it recorded delivery but like Dizzydolly above, I sent it Special Delivery which cost £4.95.

    I had previously emailed him saying exactly what I said in the letter however this was ignored. His website Terms even mentions the distance selling regulations needing to be dealt with in 30 days.

    Initially he didn't respond to the letter so I emailed and said I was taking it further but he claimed not to remember signing for one. Special delivery does record the signature online so I sent him the link to this and the Tracking ID and he admitted it was him and has now refunded. It might put you £5 down by sending this way but it does work.


    The body of my letter is -

    Consumer Protection (Distance Selling) Regulations 2000
    On xxxxdatexxxx you agreed to refund me to the value of £xxxxcostxxxx after two failed attempts to provide goods.
    Under the Consumer Protection (Distance Selling) Regulations 2000 you are required to provide reimbursement of all monies paid within 30 days and you have not yet done this.
    You have quoted me xxxxdays quotedxxxx days and this is on top of the several months I have already waited so you are clearly in breach of the Consumer Protection (Distance Selling) Regulations 2000 act.
    I have been advised by Trading Standards to give you 7 days to provide the refund before they take over.

    Well the site is still up and running so I assume so. I imagine he must bank on most people saying its only £20/30/40 and not bothering with the hassle you need to go through to get a refund.

    Would be very interested to know how many people actually had delivery from them. Doesn't seem like very many.
