  • i feel duped. the guy i went to see yesterday a said mr thomas.advice solicitor for debt an bankruptcy said i will need representation for a fee.led me to believe he would be representing me in court an pleading my case..i felt like a bl...dy criminal

    They make people feel that way so they can further dupe you out of your money. You can DIY your bankruptcy - no problem!!

    Col. I posted the link for Scarlett'd diary earlier in your thread, If you are up for it, it is a long diary. But it is a very good read and it will explain a lot about the process for you. Including the going to court bit.

    Welcome to the forum By The Way (BTW). You and Penny will find all the help you need to get through this without having to pay someone else to do it.

    Well done for facing your situation too. That takes a lot of courage to do.

    Sounds like Mr Thomas is a member of the amateur dramatics society;);). Don't worry you're not the only 1 to have people try and take advantage of those in debt crisis!!!

  • Morning Col I have just spoken to the CCCS again this morning re: my OH & my situation as we have both been advised to go bankrupt (by them).
    I can say that they are great people to talk to, very very helpful not judgemental at all & FREE! My OH was thinking of using a private firm to go IVA thank goodness we didn't go down that road!

    morning col.

    I hope you and Penny feel slightly better this morning.

    As others have said, reletivly easy process that can be done by YOU!! If you decide BR is for you then this is a very basic process of what to do!

    1. Gather up all statemnts, bills and account numbers so you can fill in the form. Decide when you will stop paying creditors.
    2. Find a court near to you, some you have to book and appointment, some offer a 'drop in' service. Either book an appointment or decide when you'd like to go.
    3. You do have to pay to go BR, its around £510, but as your on beneifits I think you get it discounted to around £350, someone else will know the answer to this!
    4. Go online, the insolvancy website, and start filling in the form. Or get a parer copy from the court
    5. Post up your SOA, a list of all your incomings and outgoings for AFTER BR, so dont include and debt repayments. I did about 5 or 6 of these with a tweek here and there after advice from the people here.
    6. Once completed print out your form and go to court.

    It really is an easy process. Dealing with the debt is so so hard and this really is a huge weight lifted!

    I do think that you should contact the cccs first though, they will offer you a telephone appointment in the next few weeks (Depending on how busy they are). You can tell them everything, they wont judge you, unlike Mr Thomas, and will help you decide which route to take.
