I phoned up the BOS about a month ago claiming hardship, they sent me the forms to fill in which I did and posted recorded delivery right away. Its been 3 weeks now and I've heard nothing. Any idea how long the BOS takes to respond to my first letter. Should I phone them My original claim was put on hold a long time back.
I would call them ! i also put very detailed reasons why i was claiming too .
They told me it can take 8 weeks due to the demand for people claiming but it would not hurt to remind them .0 -
the fos letter states
The acknoledgement of financial hardship does not mean that bank charges will automatically be refunded.there are a number of potential remedies,which may include transfer of an account to its recories department/transfer any overdraft to a loan account/cancellation of d.debits or standing orders/a full or partial refund of charges/ write off of some or all of your debt/an agreement about future payments.
My role as an ajudicator is to determine if the bank is doing enough to assist you.asyour account is with their collections department this enables you to agree a suitable repayment plan on any monies owed to the bank.we think the bank is doing enoughenough.The fairness of bank charges and treatment of customers,will be determined in the high court test case
For theses reasons i do not think your complaint should proceed.however if you disagree please contact us by 13 aug 09 to explain why you disagree and with any further evidence you would like to submit to support you claim.

I sometimes think these adjudicators simply agree with LTSB because they were bailed out with taxpayers, money.0 -

I wrote to the Bank of Scotland in May, regarding reclaiming bank charges under the financial hardship ruling. My husband died in April last year (no insurances) and I have been struggling since then to try to keep the house on. I work full time but my expenditure is more than my income and I am constantly having to juggle not paying something one month etc. I had an existing claim for bank charges on hold for £7,220 and asked if they could consider repaying this (or any) of it back as I have utilities, mortgage, council tax outstanding but cannot make any payments towards reducing this as I have no money left when I am paid!
I received a letter from the bank asking me to contact their Money Management team, which I did. They went through a detailed account of my finances and said it would be passed to the appropriate department and in the meantime, could they have someone from a debt management company get in touch with me to help....oh and they might charge me for this service!!!! I received a letter from the Bank a week later offering me £105 plus a hold on bank charges for the next 3 months so that I could get my finances in order!!! They said that I could complain to the Financial Ombudsman but they had asked them to put all bank charge enquiries on hold and so I was likely to wait for some months. I wrote back and politely declined their offer and I have sent everything off to the Financial Ombudsman. Don't know if I will get much further or not, but are the bank trying to discourage me from taking it further by telling me this! I thought that the financial hardship criteria meant that we could proceed with complaints? They haven't actually acknowledged I am in financial hardship in writing, but surely by offering me the services of a debt management company they have admitted I am???!!
Anyway, I will wait to see what happens next!0 -

I keep seeing this: rejecting offers. Where is Martin's Guide to reclaiming does it say REJECT any hardship claim??(mini annoyance rant over)

Sorry I have not responded sooner - have been away.
Without having the letter on hand, the justification is saying that they are paying for months of this year (think it was april-july) as it was deemed illegal, but the other years of bank charges were legal.
When I get home, I will find out the exact wording and post it on here!

Hi all,
I have just got the ball rolling and am waiting for a financial statement to come so i can fill it out, i have also sent off for a fully comprehensive list of charges from july 2001 as i am in financial hardship at the minute and cant afford to pay the £10.00 they want for Bank Stetements.

does anyone know what in case means? i was told by the abbey yesterday that they had looked at my case and it was now with in case who will check there decision is this a good thing very confussed what this means? was told to call today for a update and they should have some information i called today and was told i would get a letter prob by wednesday next week i said can i call tomorrow and was told prob best to call friday easy for them to say when you have over due utilities and having to pay for food on credit card0
