  • Hi,

I am thinking about reclaiming back unfair bank charges and was wondering if anyone could tell me how they refund you (providing you are successful), do they normally pay by cheque or put the money into your bank account? The reason i ask is that at the moment i am way over my agreed overdraft limit so if they refund the money into my account i probably won't have access to it.
Would appreciate any help with this.
    Thanks
    Ruth :)

It would be paid into the account where the charges have come from and thereby reduce any debt you would owe the bank.

  • Hi All,

I started my bank reclaiming with the Halifax a few months ago first of all I received a letter saying it was being dealt with in the courts and then received a letter saying I was being offered £2037.00. I put the claim in for over £4000.00! Can anyone tell me does the money have to go straight into the bank account as Im in financial hardship and my account is £1700.00 over drawn!! so really I would only be left with £300!! Is it worth ringing them because they have only worked out my charges from october 2008 to august 2009!! Please can someone help!!! :-)))

Can I ask when the period of financial hardship was? Did you lose a job last year or have reduced hours?

Have they given their reasoning for their decision because if you cannot argue against that then the FOS will agree with the bank.
Do you have priority debt arrears(mortgage/rent, council tax, utilities)?
Are they in arrears? Are you paying off the arrears?

  • Have they explained the reason behind this? If they have can you post up and we can work on it, if need be and see if we can negotiate it up higher.

"Having reviewed your account carefully, I am satisfied that the fees were correctly applied. However, in view of your current financial circumstances, to hel you i would like to offer you a payment of £112 which ammounts to the fees debited to your account beteween March and August 2009"

    Thank you in advance.

  • I've just put in for financial hardship with Lloyds TSB. The guy agreed on the phone that I was in financial hardship and gave me a number to contact to arrange for all my outgoings to be reduced:

0800 917 78 04 - Does anyone know how this service works, apparently they aren't linked to Lloyds but will contact them on my behalf, apparently it is not an IVA, but will it effect my credit rating,

And secondly, and most importantly, he agreed to pass all my case over to the team dealing with bank charges, stating that I am in financial hardship and advised me that they will contact me within 5 working days...

Has anyone else gone down this process before?
