    I've had a success letter from Abbey dated 14th August. Still no money into account though. Rang up and they say up to ten working days til appears in account. Any other people had this experience? If no money appears what should be my next move? Any help appreciated.

    Hi, i claimed £4700 from Barclays and got put on hold, so right now its probably up around £7000. I spoke to them about hardship in July and got a letter end of last week offering £3000 as a goodwill gesture. :beer:
    Its not everything, but its a good start and its come at just the right time, so thanks to MSE and everyone whose posted advice and support, its been such a great help. :T

    The letter went on to say it was their "final response" and referred me to the FOS. I considered writing back to them but decided to go straight to the FOS and ask them to take me on.
    Is there anything else i should know or need to do before i go to the FOS?

    What they have written in their final response is what you need to challenge with the FOS. Please do not simply say to the FOS that the amount wasn't enough but explain why you disagree with their decision and why with reference to the FSA Waiver(on my signature)

  • I have applied to the Bank of Scotland/ Halifax and the Royal Bank of Scotland for my charges back under the hardship rule. They declined so I wrote to the Ombudsman enclosing the letters from the bank and they have written back to me saying basically that unless I owe the Bank money I will not get anything back. What do I do now?

    Which is your main account? Is it RBS or HBOS?
    Do you have priority debt arrears(mortgage/rent, council tax, utilities)?
    I have not worked for NatWest Bank since February 2009

  • I'm in a similar situation - i'm trying to recaim just over £1700 from the Halifax. They refused to refund me even through i declared myself as in financial hardship. I wrote to the Financial Ombudsman but got a reply from them yesterday saying after discussions with the bank they are inclined to agree with their decision :-( i ahve written a further letter today with supporting documents but i don;'t think i'm going to get anywhere.... has anyone else had experience/problems reclaimiung through the FOS?
  • My main bank is HBOS and my debt is for council tax. Will this make a difference.
  • :D well im happy, i started the financial hardship claim 10 days ago, barclays owe me a mere £435 for charges, and they have today applied £270 into my account as a good will gesture i am well chuffed just for a result after 2 years of hounding them hopefully i can get what is owed to me when this court thingy is over, we'll see.

  • Ok, well, congratulation on two fronts, a new baby and an interim payment from abbey which equates to just under 50% of the claim. Does that help with priority debt arrears that you may have(mortgage/rent, council tax, utilities)?
    Are they going to confirm the amount in writing?


    Hi again. Sorry for taking ages to reply. Got a letter through from abbey yesterday. Says: "We appreciate your current financial situation. In this instance we have arranged to refund £902.79 of charges to help with your council tax and utility arreaers." Then a load of crap about in future it is important to manage my account. Which I could do if they didn't hammer me with £100 worth of charges every month. Last page of the letter then goes on to give helplines and debt councelling numbers, then at the bottom says: "Your complaint (CMS 734413) about the level of fairness and lawfulness of bank charges remains on hold pending the outcome of the test case. We will keep you updated appropriately about the proceedings with the OFT. You can check the latest position on our website."
    Don't really know what to take from that. £902 is useful and does help with concil tax and utilities. Problem is though that my girlfriend's still on maternity leave till november so we're still struggling. should I push for the rest?
