Are Abbey bad or good at repaying these fees?

i claimed about 2 years ago with Abbey, but the court case was going on so i didn't do anything else about it. now i've followed it up and they sent me a letter asking me to fill in my budget sheet etc. i got another letter about 5 days later saying they are sorry it's taking so long, but they will try and get back to me soon and if i don't hear from them they'll write to me again in four weeks letting me know what's going on. so im just waiting now.

    i'm claiming for £2046

    thanks!

Part of the Furniture Combo Breaker
Claimed for the Husband for charges we had incurred just this year which amounted to £200.

They have reimbursed us in full within about 14 days of sending in the financial hardship letter. I didnt bother filling out their form but just sent an accompanying letter explaining our current circumstances which included arrears for Electric.

They did not ask for proof of this - and replied stating that as we were in arrears with a Utility bill - we fulfilled their 'hardship' criteria.

The only reason we are in 'arrears' with Electric is they were giving us estimated bills for 2 years despite me doing readings and hen submitted a whacking bill for £1500 which we couldnt pay so they allow us to pay it off interest free at £38 per month over 2 years!!
    FAB EH!!!

Personally I think I should get the £200 refund since he would never have bothered writing the letters and I did!!!!
  • hi. does anyone know what i should do from here?

i put in a claim for bank charges refund under the financial hardship rules with the halifax. they agreed that im in financial hardship and said that they still want to wait until after the test case, but that they would refer me to their money management team, which they did. i spoke to money management on the phone and said that how can they help when i dont have any money to shuffle around as im trying to pay priority debts and cant always pay them.

i then complained to the fos who asked the halifax for a final response.

i phoned halifax to chase them up about the final response, and they told me that their letter(as mentioned above) about money management team is their final response but they will send another letter and they said that i had told the money management team that i was not interested, so i explained to them what i have said above. they then said that their final response is likely to be the same and that if i want to, i can complain to the fos.

has anyone else had a similar response from the halifax?

does anyone have any advice as to what to do now?

    regards, lawrence.

Did you include your partner's income and any priority debt arrears(mortgage/rent, council tax, utilities)?

Remind them that on March 19th 2009 the FSA sent them a letter about the handling of the FSA Waiver on Bank Charges. On the guidance it clearly stated that where a decision was made that they should tell the customer why they do not consider them to be in financial hardship.

thats the thing. in their letter they agreed that i am in financial hardship, but that they are still going to wait until after the test case to see if they need to pay the bank charges back.

So if you are in financial hardship, how are they helping you?

Still ask for a final response and we will see what it says and whether we can get the FOS to take a look.
