We have just received news that Barclays have agreed to refund £2550 of our claim for £3300 under the hardship rules. We started the process back in Dec 2008. Barclays tell us they now await result of FSA ruling before refunding outstanding difference. Fingers crossed. BIG Thank you to Martin's website.0

Have Abbey threatened to close down your current account? I would like to see the FSA stopping banks, closing down accounts. There ought to be some legal protection.
Did you write to the office on Regents Street, London?
I was thinking of applying for my statements, from Abbey, as I believe I've incurred charges, in excess of £500.
I can't risk Abbey closing down my account, at present.0 -
Because of this site we too have just recieved £1.500 of the £2.700 we were owed by them with a charming letter assuring us that if the test case finds in all our favour then they will pay us the difference. You could have blown me over with a feather, they were so helpfull. So well done Barclays and thank you to Martin's web site for making us aware.:T0

My Story....
I had an existing claim that was due to go to court in August 2007 until the OFT got involved. With not much happening for such a long time I noted with interest the 'Financial Hardship' route.
23rd April 2009
Wrote to Barclays requesting my £2915.00 in charges plus £996.69 in interest using financial hardship template.
1st May 2009
I was sent the budget planner to fill out by Barclays.
15th May 2009
I sent back the completed form.....and waited.
16th June 2009
I recieve a letter from Barclays saying they accept my case of hardship and have deposited £3060 in my account as a gesture of goodwill. Any other money (as in the interest) can be dealt with after the case is resolved.
I am delighted! It was an absolute breeze to do and took no time at all. I have now been able to get all my bills up to date and have plenty left over and put aside for a rainy day!

Bank; Abbey
amount claimed for £5'232.00 on hold
jan 22nd, 09 i woke up blind in my left eye and so couldnt work, not been with employer 12 mths so on ssp for next ? weeks.
feb 4th, i call abbey to claim under hardship rules. recieved and filled out income/expenditure forms sent recorded delivery next day.
11 days no reply
call 1, advised no one had looked at claim would be another 4 working days, advised to cancel all direct debits as no income to cover and avoid more charges. recieve a confirmation saying yes they would be looking into my claim and i would recieve a descision within 8 weeks.
4 weeks later i recieve cc summons for c tax & eon and have creditors queuing up at door.
tel call 2 abbey, explain new situation and ask do they need copies, told no promised callback.
2 days no callback
tel call 3 they have no record of previous call and promise to look into it and callback tom pm.
no callback,
tel call 4, diff operator same reply as last call.
no callback and very frustrated
tel call5 put wifey on phone (has a way with words) :Abasically she told them we have court dates and need to speak to someone senior who has a clue what is happening. so claim is now escalated by a supervisor promised callback.
2 days no call back
tel call 6 now very emotional at lack of the understanding of what "hardship" actually means, explain that our position as private tenants is possible eviction if no rent paid. now we at week 7,
4 days left to 8 week deadline and after 4 more tel calls we are still without a descision
confirmation by letter that they have gone over 8 weeks and no descision yet so i can involve ombudsman.
week 9 eyesight back to normal ( retrobulbar optic neuritus)
contact ombudsman and fill out forms to get their help.
tel call 11 advise them we have passed it to ombudsman
recieve a letter 5 days later with a gesture of goodwill of £1'280.15. this does not cover the basic houshold debts and they know this so
tel call 12 tell them this and advise we are withdrawing the money to pay said bills to keep out of court. they promise call back.
no call back 3 days later.
have drafted a letter accepting their gesture of goodwill as interim payment and have deducted this from total reclaim but have added interest on the previous total .
no reply yet its been19 weeks from start of hardship claim. awaiting ombudsman to pursue this final amount of £6'248.30. wish me luck!!0 -
Just had my hardship claim accepted £5991.00 cant beleive it did not think I would get anything near that. Got the letter today and sent my acceptance stright back :j:j:j:j:j:j:j:j:j:j:j:j

BARCLAYS BANK PLC
Just to say that I have just received £3500 through claiming hardship. Originally denied hardship claim by Barclays but then they wrote me a letter two months ago saying their policy had changed. I didn't respond but they sent me another letter and so two weeks ago I sent it off and voila I have just received it into my account.
Not repaid interest but hey ho!

Hi No abby hav'nt closed are account they have been very helpful, yes write too head office at regents street but keep copys and also send recorded delivery, Apply for your statements this will cost you £10.00 but it's well worth it.:rotfl:;)Regards

Something needs to be done about this bank. They need a damn good kicking.
The FSA should reinforce the hardship exemption waiver. It was us, the taxpayer who bailed them out.0
