    Thank you Lj for your post, I rang the halifax and they have told me a letter was sent out yesterday offerring me 70 quid I am claiming for £3,000 will ring the customer relation dept now ..

    Hi Irishgirl - I have also just spoken with the halifax and a letter was sent to me ysterday for £175 (my claim is for over £3000 also)

    I quoted the social security act and was told that they are entitled to take this charge as it is a charge resulting from a payment I have asked them to make.

    I am really upset (more so than angry) I really was hoping this money would get me out of the mess I am in. I just don't know what to do because if I wait for the ombudsman then I am going to be in an even worse mess.

    I'm writing as i've got a limited success, was claiming financial hardship, the Halifax just kept quoting the usual excuses until i approached the FOS, within 4 weeks i had an offer of £175, compared to my charges of £1585 i wasnt impressed but the advisor got back to Halifax and they wouldnt budge on money but said they would suspend all charges for 3 months so i could get back on my feet, then apply again in 3 months. This cheered me up alot as it means i stop the vicious circle of debt.

    LJ you are in the same postition as me I really need that money to get myself sorted out for once and all...hopefully we will find advice on what to do next I am typing a letter up now to halifax using this template found here no harm in keeping on trying?

    I tried to put a link for the template but the post wont let me! you can find it in claiming back under financial hardship

  • :rolleyes:I/ve been in the same position with halifax, claimed £3000ish in charges, they offered me £133. Eventually I have taken this because the 3 months without charges will stop the circle of debt. Im just crossing everything that the court case on 22nd June has a favourable outcome for us all then we can get the remainder back!!

    I was told by customer relations advisor that I was looking at about a year in order to get the remainder back, when I asked about the court case.
    I take the banks don't think it will be resolved in june this year :(

    Hi all can any 1 help ive sent my claim of under the Hardship cases and have not received a reply does any 1 have the telephone number for the lloyds complaints place so i can call 1st before sending another latter 2 lloyds
  • We have sent the original template letter to Lloyds clearly explaining our hardship. They have responded to us acknowledging our hardship, but stating that our case will be put on hold until the full review takes place. Could someone tell me if I can take this any further or are we now stuck??

    received: £866 (so far)
    time taken: 6 weeks

    Got a goodwill payment of 866 into my account on mon. letter sent saying my case will be concluded when a judgement is made on the OFT case.

    I've quoted you because you stated about the Social Security and Administration Act 1992. An often misquoted and misread and misunderstood act.
    Under the SSAA 1992, charges within the act are not BANK CHARGES, but it relates to debts assigned via a court. When benefit goes into your account, it is treated as income. The SSAA 1992 and the fact that a bank cannot take bank charges from Social Security benefits is an unfortunate myth in this instant.
