  • Any one know of any success stories from Northern Rock. Started the reclaiming process in July 2007, had a couple of standard letters saying NO then sent the letter stating i was going to court. They said everything was on hold until test case was heard.. Applied for refund under financial hardship - STILL NO.... infact they were quite rude and un helpful - which is a kick in the teeth following the problems they have been faced with over the last 12 months or so. Decided to get help via ombudsman - im in a queue waiting for their response - Has anyone had any luck from them, my last count for high charges was about £4k god only knows how much since 2007...!! HELP/ADVICE NEEDED PLEASE.

    Do you have any priority debt arrears(mortgage./rent, utilities, council tax?
    I have not worked for NatWest Bank since February 2009

    ....yes everything is snowballing up - rent, c/tax unpaid bills.. Ive already completed the form for the Ombudsman. Just feeling a bit deflated. I am pleased for those that have had success, gutted that im still waiting after all this time... x

    I take it you submitted to Ombudsman:
    Schedule of charges, income and expenditure form, notices of arrears.
    I would add a further thing, I would write down firstly what caused there to be insufficient funds to cover the outgoing payments, ie unemployment, cut in hours, and how the charges caused you to be unable to meet your priority debt arrears. Furthermore, I would look at an acceptable amount to your hardship claim possibly the repayment of priority debt arrears, suspension of charges for say 3 months to allow you to be able to get on top of things and an amount that may take you under your overdraft limit if you have one. The amount may no equal the total of your claim but remember anything outstanding is still on the table at the conclusion of the OFT test case.
    As an aside, usual timescale on a clean case is 12 weeks with the ombudsmanm, it may take longer if there are additional things required by them.

    Hi

    This is my first time on here, decided to lodge claim in April 2007 with Natwest, Lloyds and Nationwide and Midland. Natwest agreed to make a payment and paid 65% of the claim. Midland Offered but my OH decided to wait till outcome of testcase. The other 2 decided to say no and then after numerous letters the claims were put on hold awaiting an outcome.

    In Oct 2007 we moved to Australia. Everything going well OH earning a good wage and no shortage of work, i got a job and hey presto better off than we'd ever been. Dec 08 i was laid off due to lack of work. May 09 OH on short time struggling to get work OMG :mad: oh WALKS OUT.

    I'M STUCK/STRANDED in a country with three children and $170 a week to live on. Mortgage of $2367 p/m. Can't claim anything as not been in the country long enough need to be here two years. Have now exhausted my savings and can't even get home my parents aren't in a position to pay for my airfare as they are both retired.

    I want to resurrect the claims i have and have filled in an Income and Expenditure form for all three, have enclosed notification of two year waiting period, mortgage arrears notice, overdue phone bill notice, details of bank charges etc. Is there anything else i need to enclose as really concrened we could become homeless. Have applied to mortgage company under extreme hardship and waiting to hear if they'll suspend payments. Can't place house on market as no idea where OH is!!!!

    just heard back from them, they are saying although iam in hardship they are saying my claim is still on hold until after the test case, is there anything else that i can do ?

    anyone know of any success stories with rbs? Sent in the template letter, had hardship form sent back with information saying that if we're found to be in financial hardship they can then downgrade our account, cancel any non essential direct debts/standing orders etc and cancel maestro cards, can they do this or is it just to put us off?
    :laugh::Sometime I try to be NORMAL. . . But it gets boring so I go back to being me. . .

    Anyone know why it today's world Data is kept on your credit file for 6 years, its extremely unfair and I heard its not lawful, there is no law on this, its about time Martin Lewis (how do you e-mail martin Lewis?)also took up this matter with the Office of Fair Trading.

    With people being discharged from the Big B,after only 1 year I believe why should we all accept that data on defaults/ CC Judgments etc remains on for 6 years, it's totally unfair, 1-2 years Max would be more in keeping with the modern world we live in.

    Anyway I would be interested to hear form any other learned friends on here why this can't be Challenged, especially if its not actually in Law for data to stay on your file for 6 years?

    Agreed. Its high time the FSA looked at this. 4 years to me is good enough. They're all in each others pocket: banks and regulators.
  • Just got £3000 back from these two; The forms they sent didn't really give a clear overview of my circumstances so I sent a simple covering letter.
    Natwest asked for a fax of my Council Tax summons, which I sent.
    I also sent them both a reminder when they took three weeks to get back to me. They both settled for the full amount. Natwest paid interest too.
    I also claimed for Business Bank Charges. This claim failed as the Company had been dissolved; I am referring it to the Ombudsman, just to see if they'll budge.
    Be persistent. Don't be ground down.
