That's great Karen - congrats! Our complaints were probably all signed off in one hit.
Now we just need the courts to decide in our favour and then we can have the rest of our money back0 -

Its called the Social Security administration act 1992 (chapter 5)! It basically means in simple terms if you have £90 benefit going into your accout no matter what the status is, the bank are not allowed to take their charges!
Does anyone know exactly what this is asthe act is very large!
I am trying to claim under financial hardship and I sent a letter to Halifax 3 weeks ago but have not recevied a reply.
I receive Child benefit, WFT Credits and Childrens tax credits so does this act apply?
Thanks0 -

I put in i calaim for financial hardship with Nat West in April. I was told at the end of April my application had been accepted and that a offer would be sent out to me as soon as i returned my card and cheque book and that they would send me out a new card.
To cut long story short my new card never arrived .I kept calling to be told it was in the post!! After three weeks i received a nasty letter from one of my debtors threatening me with court action unless i paid up (council tax) .
In desperation i called Nat West in Edinburgh and spoke to the most helpfull and lovely lady(dont know if im allowed to say her name?) who advised me my card had never been ordered.I told her about my court threat. She told me to go into my local Nat West and get them to fax a hand written letter from myself promising to return my old card etc to them when i got my new one etc etc. Then she could arrange my offer letter. This i did yesterday.
Today i received a offer letter from Nat West for £5490:j.
I still do not know how much i have paid in bank charges but by my estimation is would be about half that amount.
Needless to say i have accepted without pred etc etc.
I would just like to say a massive massive thank you to everybody who has give me advise and support on here.
:money:Martin should be made a lord.Failing that i hear there is a job going at 11 Downing Street soon. Without his letters i would still be chasing my tail trying to get my money back.
So for those of you who feel like giving up your claim dont! I have 5490 reasons not to and so could you.
Once again thank you to everybody. I now now clear most of my priority debts and sleep at night.

I printed out the letters off this site quite a while back - it has to be 12 months easily claiming back just over £1000 in bank charges from Barclays. I received a reply telling me that I had obviously been mislead and banks were justified in charging the amounts they had.
I had claimed on the gorunds of financial hardship as I became ill with Fibromyalgia 5 years ago (aged 30) and lost my job as a result. As I was the higher earner it really has been a struggle to keep going, however we've just about managed with help from family.
Then out of the blue about 4 weeks back we received a letter asking me to fill in a budget/expenditure planner and telling me that Barclays had changed its criteria for looking at financial hardship claims. I duly filled it in fully expecting a firm refusal.
I then received a letter one Friday morning when I'd been particularly poorly and my husband had taken the day off to look after me, I started squeaking and flapping about "Oh, God, what now?" he says with a look of total panic, which turned to utter shock when I showed him the cheque. We received a cheque for over £1887, that's over £800 more than I'd requested - although admittedly I hadn't had all the bank statements when I sent the letters.
I can't thank the site enough! That has made a huge amount of difference to us. We've managed to sort the budget out as best we can (we don't have any loans or credit cards, it's simply that I can't work due to severe health problems). Having this money back means that we're able to do some disability friendly home adaption/improvements as well as keep our finances in a decent state from now on.

1834 pounds repaid (and I only asked for 800 pounds)! Took six months from first letter to cash into bank. Thanks Martin0 -
Ive have just sucessfully won back my bank charges of £924 after three years of waiting . By claiming through the hardship way after being made unemployed 6 weeks ago I sent hsbc a letter to say I was in hardship. then after fourteen days I had a reply to say I had to prove my hardship which I did by filling in a expenditure form, after three attemps of doing this over the phone with them. Then they rang me today to say they would repay me back in full, so thanks to money saving expert I claimed the full amount back.

can someone tell me why there is a freeze on us consumers claiming money back from banks but there is no freeze on banks to carry on charging unrealistic amount of money from consumers?0
-
Its because the courts are yet to prove that the charges are unfair. So the bank can keep charging us until they rule its unfair. Thats why the banks dont want to pay out incase the courts say that its ok to charge what they do.0
