    I have just returned from holiday and it is very nice to see people strongly supporting what I am doing, and Happychappy and Blatzer pretty well say what I would like to say to Dom Tom (Or is that Dum Tom?):rotfl:
    (Or even "I want to be Dumped on Tom"!):rotfl:

    So I won't waste my breath on him!:mad:

    Anyway, on my return I have had notice from the Court that (Orange)..................
    'I intend to defend all of this claim '
    Orange now have 28 days from 24th April 2009 to file a defense.:D

    The next move in this game of 'Chess' is to Orange.
    As far as I concerned they are trying to defend the indefensible:rolleyes:

    I am just posting to keep this 'live' and bring it to the attention of people who havent seen this post before.

    In the meantime I am still waiting to see what defence Orange are going to offer:D

    If they do turn up to court & even if they dont turn up but appeal expect the following.

    They will object to your fees on litegation. Your charge rate per hour is not in line with approved proceedures & they will win a reduction in your charges. The court will reduce your claim to the correct rate per hour & reduce it further by a rate £150+ per hour for the time the plaintiff spends on the litigation, this will wipe all your claim out because of your inflated rate for a bit of admin work.

    Best of luck wasting your time.

    You do realise being unreasonable in court costs money.

    Google "litigant in person" & get the proper charge rate per hour before you submit your claim to court.

    If it's being heard in the Small, Claims track Orange aren't allowed to claim more than £260 in legal costs and only then if it's a claim for specific performance or an injunction.

    You cannot claim £15 per hour for your time. In likeliehood you will not be able to claim anything.

    If you are able to claim costs, it will be at the litigant in persons rate which is £9.60 per hour.

    Actually, in my claim, because I did the thing online I was restricted to 24 lines of about 7 words, so although I mentioned charging for my time no actual amount was stated. Most of what I have to say will be said in Court if it comes to that.

    I will take into account any Wannabe Solicitors':D advice if and when I go to Court.

    In the meantime I am just doing what this Forum says at the opening.........

    Or an actual solicitor's advice who can point you to Part 48.6 Civil Procedure Rules....:rolleyes:

    Oh and having just checked, it is actually £9.25 per hour. However, as it is Small Claims you have not got a hope of actually being awarded it.
