Had this email this morning from Consumer Direct:

From the information you provide, I would recommend in the first instance that you check carefully the terms and conditions of your contract with Freemans as these will dictate when the contract is concluded.

If the terms and conditions state that the contract is formed when payment is accepted from the purchaser, you could argue that, as your account has been debited, a valid contract has been formed and Freemans should honour the contract at the advertised price.

If, however, the terms and conditions state that the contract is formed when the goods are despatched by the company, they can argue that, even though payment has been taken, the contract has not yet been concluded. If this is the case they should refund you in full if they will not sell you the goods at the advertised price because a pricing error has been made.

Companies should take steps to ensure that the prices they advertise are correct and not misleading to consumers. I would be grateful therefore if you can provide, if possible, the following information so that I may pass the details to the appropriate Trading Standards Authority.

- the make and model of the bed you ordered

- the website address/page that displayed the goods at the incorrect price

- your address

- the address of the trader
