    Hi

    I am just starting this whole process off at the moment by trying to get hold of all the charges that have been levied on me. I want to include the cheque in with the letter so there is no reason to delay on the 40 day rule, but I am not sure who to make it payable to. Please can someone fill me in?:confused:

    Hello, i am in the process of claiming back my unlawful charges. Royal Bank of Scotland is the bank i'm claiming back just over £1400 from. I have taken them to court and they have been given fourteen days from the 12/06/06 to respond. This is a really worrying time for me as i really need the cash but cannot afford for them to close my account if they do give my money back (i have a £1400 overdraft) as i am a student and desperately need the O/D. My credit in the past has been really bad due to personal relationships and poor finances. I am slowly starting to pay off my debts with my creditors [intirum justitia, Barclaycard and Wescott] all of which have been fairly understanding. But i have looked at my credit report via checkmyfile.com and my credit is still extremely bad as it looks like the accounts that were sent to the collecting agencies (intirum and Wescott) have not been being paid. How long will this take to clear. Need advice PLEASE!!!

    I've been Money Tipped!
    I had two credit cards which were paid off and closed. Lloyds TSB was closed 2 years ago and capital one about 3 years ago. I still have my account numbers, but have moved since paying the accounts off. I know that i was charged by both for late payments (due to unemployment). Is it worth trying to reclaim the charges, even though the accounts are closed?

    I'd say give it a go, there are numerous other people been asking that question over the past couple of weeks and the general consensus is yes you can claim back, closed or not they have still charged you unlawfully.
    The only thing is you can only claim back for the past 6 years.

    I have just won mine against First Direct and I cannot believe how easy it was (although some banks might be a bit more awkward)

    Hi,

    You should try and get a parachute account if you haven't already. This is in case they do close your account (some do, some don't) and is worth opening before your claim goes through.

    Check out basic bank accounts as your credit rating may affect your ability to apply for others. The CAG forums have some good threads on basic accounts - search on there for 'parachute' and you'll find them.

    RBOS generally leave it fairly late to cause you maximum cost (you get it back though) and try and put as many people off as possible. Stick with it and you will get your charges back. If they do close your account you might have to use the refund to pay back the overdraft, but think of the interest you'll be saving!

    If you have any more questions post here or on the CAG forums - There are a few CAG members like myself here as well so you've got lots of support and help available.

    Yes, you definitely can claim from closed accounts (within the last 6 years).

    By law they have to keep the information for at least 6 years anyway so no problem there.

    Providing them with your old address and account numbers if you have them should be enough.

    (data protection act in play here to protect me,.....after all, it protects the consumer as well as the companies.)

    Sorry, I just had to pick up on this because it's representative of people's perception:

    The Data Protection Act was put in place to protect PEOPLE, not companies. The way that companies are using it to shield themselves from telling you anything you need to know is an absolute disgrace!

    This has been a bugbear of mine for a long time, and I once laid into some people who were trying to tell me that my data was for them to use as they wished despite my express instructions to the contrary. They only tried it once, mind you! :mad:

    My advice to anyone who gets a phone call asking them to confirm their details is NEVER EVER confirm. They called you. Either they know who they're calling or they don't. How can YOU know they are who they say they are?

    After telling my mum about my success of getting my bank charges refunded she decided that she was going to try and claim hers back as well. She sent a letter and postal order for £10 off to get her 6 years bank statements. She has heard nothing back from them and the 40 days is up on Monday.

    What does she do now? She still has the receipt from the post office for the postal order, if she phones them can they tell her if this has been paid to the bank? Does she write another letter to the bank?

    Any help would be appreciated. The bank is Bank of Scotland.

    Some people have had issues with paying by postal order, although there's no reason why they shouldn't accept it.

    I'd call them to find out what's going on, and also check on the CAG forums as there's a good thread there on what to do if the bank doesn't comply with the DPA request.
