is this right? has anyone else had this through the post?
yes then comes the allocation questioinare then lloyds offer to settle your claim
Lloyds seem to be pushing right to the last minute before settling .In my opinion in the hope that more and more people will drop their claim at each stage. When they realise you are prepared to take it all the way they pay up.Wish I could stop editing EVERY post I make :mad:0 -
melpomene wrote:BUT : will the fact that i entered a voluntary agreement so as not to affect my credit rating adversely (ie scared of banks!) mean I can only claim for charges before the date the agreement took force? NO
ALSO : can i claim for the debit interest each month or just the fees/one offs? The calculations are complicated, but in theory, you could reclaim the interest that arose from the charges
REVENGE : can they get their own back on me by blacklisting me/threatening my status? They could close your account. There are recourses if they try to default/trash your credit rating
I'm new to all this & a bit of a technobimbo, so would love to know what i should do next. I've just been through all my statements & letters & have noted the charges, so am ready to start! Click on my sig and join, we have step-by-step, template and 26000 people going through the same process.
Melref post #710 : do i need to make FD aware that I am disputing the charges, or do i go ahead & do it? They'll be made aware when you start writing.

wotnot wrote:Hi there, Im new to this so any help would be appreciated.
I have just sent the 'Data Protection Act Request -- Letter - List of charges' letter to my banks but Im not sure in what order I need to start the process on the 'http://www.consumeractiongroup.co.uk/forum/forumdisplay.php?f=33' list of letters? Have I sent the right one first as this letter was fourth on their list?
Anyway the Nationwide did alot of back of the room whispering before finally accepting the letters (I have two accounts) but only accepted one fee and Barclays had their manager straight on the phone to me wanting to save me the ten pounds and making out he didnt understand the letter at all!
Many thanks
Don't send the letter until you have your list of charges. The letters are in alphabetical, not chronological order, so the "preliminary" is the 1st, (2nd if you sent SAR, of course) then "Letter before Action".0 -
Hi
Am new to all this so bear with me! Have put in a number of claims....And have received a few responses.. Mostly they state that I agreed to the terms and conditions etc and therefore have no right to request anything back - is this right?
With regard to one Credit Card Company I noticed yesterday that they have credit the credit card account with about 50% of the monies claimed - although we have had nothing off them asking if I agree to this amount.. what should I do (others have offered partial refunds and a signature etc)..
One last question.....Does this also apply to catalogues?
Many thanks yous - Confused Psychokatz!0 -

I sent a DPA request to Natwest on the 13th April. They have taken my money for the requested charges but I've never received a list of those charges. I therfore called them on the 1st June and they denied all knowledge of receiving my letter (but hey they still took the money) and asked me to drop a copy in to my local branch, which I did the same day but have still received nothing. What can I do now?Married 29th Feb 2012 :beer:Determined to lose lbs and save £'s30 day shred started 4th June 2012 - Days completed 15 :eek:0

But they will say anything to make you go away.

Keep going. You haven't agreed to it, just keep going after the rest.

According to my calculations, the 40 days for them to complay with a SAR expired on 23/05, they are now seriously beyond their deadline.
I suggest you write them a stern letter, with a photocopy of the cheque stub and the banks statemnt showing where cashed, and say that they have now gone beyond the 40 days given to them under the DPA. Tell them that as a goodwill gesture (yes, we can do that too!! lol), you will give them a further 7 days to comply in full before you 1) complain to the IC, 2) lodge a county court claim to force compliance under section7 of the DPA 1998.
There are now templates on the consumer action group for this too if you're unsure how to phrase it.0 -
Do you have to include the 'I would be happy to come to my local branch to collect' bit in the DPA letter? As my local branch is 2 hours away! Many thanks.0
