I.ve seen this question before but now can't find it again,
I'm new did you quess.
The preliminary letter refers to
"you have taken £xxx plus £xxx which you have charged me in overdraft interest for the sum which you have taken Total £xxx:o
I do not understand this , does it refer to the interest charged as per your bank statement
or does this relate to the 8% on the spreadsheet. I was under the impression that this related to the possible Court action ?
Confused would appreciate you help

You'll have to be more specific as to what a telegraph thingy is.While looking through other people's comments about claiming from Lloyds TSB it seems that they like to close accounts with the excuse "customer not sticking to T&Cs". Is there any comeback for this (seeing as they haven't stuck to their T&C to operate in a legal manner). I really need my overdraft!
When you reclaim your charges, will that not clear your o/d? At least a good part of it?
Sadly, at the moment, the OFT are not doing anything about this, even though they are aware of it. That's another campaign for another day.Also, would it be worthwhile asking for only part payment, say all charges over the last year in the hope they won't close my account? And if I do, should i tell them how much I could claim back in total if this offer is rejected?
Sadly, no. They are as likely to close an account for £100 than for 5k... There is no rhyme no reason to how they do it, as it just pure retaliation and hoping to discourage people from reclaiming their charges.0 -

Does the law allow reclaiming on ALL charges - and not just unauthorised overdraft charges? I'm keen on recouping direct debit fees that have been slapped on my account. Can I do this?

I notice a few comments concerning the possibility of the bank closing accounts where charges have been re claimed.
Is this likely with a credit card , or would the fact that you had an outstanding balance prohibit this ??0 -

Basically it's better if you take them to court then and claim some more! But even some of this back will be awesome!

Hi Just some advice needed really as the consumer board is not working for me. Ok well I am doing this on for a friend as well lets just say she is not very good with money. I wrote a prelim letter to halifax to ask for £145 back they sent her a letter a couple of days ago saying they will give her £78 but state something like if this keeps happening they will close her account. The problem starts now, she miscalculated her money a few days ago and has had a £39 charge come out, making her overdrawn so £28 will come out in a few days, but she also has another £39 charge due out today so when they all come out she will be down another £106. Where do we go from here, do we send a letter saying we want the £106 refunded now aswell, redo the process from the beginning for the £106, count our losses with the £106 or something else. The bank is Halifax by the way, anyone else had any dealings with them and how easy were they to get your money back. Have a good day.

Ok, I'm not going to answer that directly, as it's all about self-empowerment. Instead, I want you to answer it after I give you the facts, ok?
The law says any charge must be a genuine pre-estimate of the institution's losses through brought on by your breach of the contract.
The law states that penalty charges are unlawful.
Now, what do you reckon?0
