Hi this is my first post.
I was wondering if anyone knows if this applies to northern ireland for refund of bank charges from the Nationwide?
Also can i claim from Nat West for late payment fee. The bank is in England Is it the bank that comes under English law or does it come under Northern Ireland law as that is where I live.0 -
This is a long thread - hope I’m in the right place.
I successfully reclaimed unfair bank charges in the county court from A and L. A week later, they write to say because I cannot accept their terms and conditions they are closing my account in 28 days.
I have written to The OFT to say that as they have announced penalty charges are unfair - I have the right to reclaim them, this action from the bank is unfair and undermines their own findings, and please can they investigate.
I have also posted this on the Bank action group. I’m not sure if anybody else has had this experience but I will post the findings of the OFT here.

I successfully claimed back charges from Alliance and Leicester. Today I had a letter stating that "As it is clear that you do not accept certain aspects of the terms and conditions for the operation of your account we regret that we are unable to continue to offer you banking facilities. We are therefore now giving you notice that your account will be closed on 12 June 2006"
Is that petty and vindictive? Or just bullying?0 -

The bank action group has a suggested letter format for the OFT. I suggest you apply for some 'parachute accounts' now online to cover yourself.
It's an interesting development form the banks. The A&L make a large proportion of their profits from bank charges and they are subject to a speculative take over from a Spanish bank. Now might be a good time to write to the National Newspapers and explain that you are being penalised for recovering unlawful bank charges which the OFT say you have every right to reclaim. I hope the OFT takes action and I hope the media notices this.
Meanwhile hold onto your hat. We are all in it together. They cannot get rid of all their unhappy customers!0 -
I have read a lot of posts but not had time to read them all and I know this was asked early on in the thread but I never saw it answered.
Does the same law apply in Scotland? I'm not sure that we have County Courts up here.

Hi everyone, I'm 'new' so apologies in advance, as I am sure there are obvious answers to the following..!
Right, I have been scanning through post's, articles etc on claiming back charges. Just called my bank (Abbey) who are sending out the past 2 years statements. (I have to send a £10 cheque for the 4 years before that). I am a bit confused... Does the charge have to be more than the amount they declined? Or doesn't it matter? Do they HAVE to refund me ALL charges incurred on my account over the past 6 years, or just part of? And finally, if it is illegal - or whatever the correct word is! Why isn't EVERYONE claiming charges back?
