From looking at various chat rooms it seems to be up to you. I've just filed a court claim with Lloyds for £448 + 17.9% coz that's what they charged me (+ court costs o course) - but some people recommend8% and I've also seen a thing about it on the Bank Action Forum w/site which says that you need to count the days since you were charged to calculate the interest - there are examples to help you do this. I just think that if they want to charge me 17.9% interest - why shouldn't I charge them this amount - I know other people have. The letter's that you send to the banks DO NOT CONTAIN the interest.
You ONLY apply the interest when you apply to the courts.
And the 8% is the interest used by the courts, not the 17.9% that you have requested.0 -
Right, gottya! So I shall take out the bit in the standard letter that says "plus £XXX which you have charged me in overdraft interest for the sum which you have taken. Total £XXXXX"
I'm happy with £447, especially as I've got Intelligent Finance to look into also!

Thanks kaznelson, 2nd letter on ot's way back to them. Fingers crossed they'll pay up rather than fob us off, don't really fancy going to court for £30!0 -

How awful is that. I am to reply within 6 weeks to say if im accepting and if i dont they will take that as acceptance. I will write a letter to say i dont accept so any wording would be helpful. I am also hoing to call so i can say i made a telephone call to the same effect.

Halifax advised me that they are still in the right to charge me but have offered as a gesture of good will £162 to end the whole complaint.
WHat do i do - accept or advise them that it's not good enough or just refer it to the court?0 -
My 14 day LBA time is up today amd im in a similar boat. They offered £70 so i rang and said no thanks. Now scottish and english ways of this are different. I have to hand paper work into a court and the earliest i can manage is next monday, unless i can get a day off work, which i doubt.To top it off - im worried i have now scuppered my chances of getting money back as i have not stuck to my timescale...0

Hope some of you clued up types can help
Trying to get my head around what I can claim back for - I've requested all previous statements from my bank for the last 6 years(in the middle of the 40 day wait)
What am i looking for when I get them?
I have an overdraft with the bank which I pay interest on a proportion of but the total is an agreed limit. I know off the top of my head that every month there are 2 transactions on my account from the bank.
1st is the interest on the overdraft, Fair enough right?
2nd is what they just call 'overall charges'
This second one I take to be what they charge me for going over my overdraft limit. This may or may not be more than the amount I was over my limit, varies month to month, but can I claim it back anyway? or only the times when the charge is more than the amount I went over my limit?
Hope I explained that well enough for you to comprehend.
Would be very grateful for any advice
If I can claim anything back it would really help me out

P.S When I sent my request for info letter they sent me back an HSBC form to fill in and hand in to a branch. I've done this but what come back do I have if the junior I gave it to lost it down the back of the computer? worried that the 40 days will be up and they'll have no record of my form being handed in.0 -
Over the last 3 years I have been charged £1200. Mostly charges for going over my overdraft limit (£30 per transaction). I followed the directions on this website and sent the bank the two letters from the bankactiongroup. I am now ready to proceed with court action but have just recieved a letter from my bank saying that they do not agree with my claim.
The letter states that 'The contract between the bank and its customer is governed by HSBC's standard Terms and Conditions. In the respect of unauthorised overdrafts, the relevant clauses are 7.11 to 7.18. In these circumstances, there is a process that involves the Bank considering whether or not to pay the item. A fee is payable for this and the fees are as set out in the published price list'.
They also sent me a copy of the price list.
Is the bank correct in what it says or can I still claim for these unauthorised overdrafts???
