Claim back any unfair bank charges! Article Discussion Area

Good morning
We're making a claim against the Halifax on two different accounts. We sent the first letter asking for repayment. They sent us an offer which is just over half of what we're asking for. Before I rejected that offer, I thought I'd better just double check that we can get new bank accounts. NatWest have replied this morning, turning us down for a joint account. I'm not really sure why because we're quite good these days but there you go.
I don't know what to do now, should I accept the offer? It would obviously be a nightmare if they withdrew overdraft facilities or closed the account.
What do the Halifax tend to do historically? Has anyone got any advice?
Thanks guys,
Clare0 -
Have a look at the Halifax board on CAG and hopefully you'll find first hand stories on other people's experience with Halifax.

It's 14 calendar days, and they won't stick to your timeframe I can guarantee that. They seem to think that deadlines set by consumers are flexible, but theirs are notLittlewoods catalogue - won back charges of £300 by default.

Teacher2301 wrote:Have been an avid reader of this forum - and wish to share a little success - trialled the reclaiming charges with my credit card company and they paid up on the second letter (and paid the interest as well). Not so good with Lloyds TSB though. I fear many people are starting to reclaim their charges. It was for only £30 but that's still my £30! My wifes charges total about £750 - so wanted to test the water first. Anyway, I have read a few threads that have started to proceed with the legal stuff, so I'll try my luck - a bit shunned by the fact someone had to pay £120 court costs - is this dependent of the amount being recovered or a standard fee (I thought it was just £30!).
Keep up the good work MSE and I'll update when I can.
Good luck to all those who are going through the legal proceedings to get your money back.:A
Don't forget the court charges are also recoverable!Littlewoods catalogue - won back charges of £300 by default.

I am amazed by this and was wondering if you can make a claim for charges made on an account which is now closed, i was a student with natwest and as you can imagine racked up a fair few charges. So i was hoping i could possibly get these back or do i lose the right to do this when i closed the account.
Thanks for your advice in advance.
Matt
Hi there,
You can claim back 6 years on any account be it closed or not. Indeed you in a favourable position with it being closed as they can't ask for any money back from you, i.e. overdrafts. It is and and always was your money, so get it back!!
Good luck matey!Littlewoods catalogue - won back charges of £300 by default.

Hi All,
ADVICE URGENTLY NEEDED.
My mum has just been offered £490.00 towards her charges of £1000.00. She phoned the number provided (barlcays) to say she wasn't happy with amount offered and was transferred straight to answer phone. Left her name and was called back today. They say there not prepared to offer anything towards her loss. She asked why certain people were allowed to negotiate and not others. The lady said "different people have different needs". My mum asked would they put this in a letter (Discriminating against people) they said no. They said this is full and final and she can do whatever she wants she won't get anymore.
They also said this to me so i accepted a figure of £250.00 rather than £385.00.
Obvioulsy my mums is alot higher but she doesn't have a lot of money should she fight for the £1000.00. £490.00 is alot to her!! and with Court Charges etc i don't want to see her struggle for something she won't get.
Have any banks been to court yet?
PLEASE HELP!!
Thanks0 -

Firstly, the banks will ALWAYS offer a small 'full and final' offer, if you have read through this thread then you will see that usually the banks will oiffer the requested amount after another letter goes in/it goes to moneyclaim. Don't bother phoning it never works and the people you speak to rarely have the authority to credit back the whole amount, but they are trained to make you feel like you are in the wrong! I personally would write in with the letter supplied on this thread declining the offer.
Sometimes the banks have defended, but more often than not they give in right at the end. Mostly though, simply writing will do it. If not and a claim does have to go in, threy will usually pay up before it goes to court.
Also remeber that the court charges will also be refunded, and if it does go to the moneyclaim stage, then you can asloa sk for 8% back too. Also remember that the banks does not want to opay and will try to scare your mother off saying that they will defend and they will win (standard response). They won't.
By the way 49% of the requested amount is a terrible offer, I would definitly turn it down if it were me. Yours was better but you could very easily have got the full amount.
Good luck, let us know what you decide!Littlewoods catalogue - won back charges of £300 by default.

Thanks very much for your time.
I will discuss with my mum and advise her for the next steps.
I agree with your comments but sometimes when you listen to them you start doubting yourself
Thanks Again.
